14. Welcomes the fact that, in a manner broadly consistent with various regional transfer control agreements and instruments, including the Council Common Position of 2008, arms transfers may not be authorised if States Parties consider that there is an overriding risk that the weapons will undermine peace and security or may be used to: (1) violate humanitarian law, (2) violate human rights law, (3) commit organised crime or (4) commit terrorism; encourages all States Parties to develop elaborative guidance so that these criteria are applied with due rigour and consistency;

Deplores that a number of partners of the EU and its Member States are engaged in grave violations of international humanitarian law; calls for the EU to seize all bilateral tools at its disposal to effectively promote compliance with international humanitarian law by its partners, including through its political dialogue and, in the event that such dialogue yields no results, to consider other measures in accordance with the EU Guidelines on promoting compliance with international humanitarian law.

Calls for the EU and its Member States to urge the UN Security Council to use all available tools, such as the use of targeted measures, the establishment of fact-finding missions or commissions of inquiry, and judicial mechanisms such as referrals to the ICC; requests that the power of veto not be used in Security Council decisions on issues related to humanitarian action, that respect for international law norms that provide for the protection of humanitarian workers be enhanced, that acts that could constitute violations of those norms be systematically investigated and that those suspected of being responsible for such acts be brought to justice.

As usual, however, we are witnessing the habit of blaming Europe when it suits, only to ignore it irritably when Brussels disapproves of the agreement on sea repatriations, which violates humanitarian law and lines the pockets of African dictators – some of whom are today being toppled – and continuing even today to lavish billions on the Libya of Mr Gaddafi, or refusing EUR 10 million of aid offered to the Italian Government by the European Fund for Refugees, which Italy decided not to use, possibly because it would have to be spent in keeping with Europe’s transparent rules and not the in-house criteria of the Italian Civil Protection Agency.
