According to the "European Convention for the Protection of Human Rights and Fundamental Freedoms" (ECHR, 1950), which is also binding for the European Union by virtue of Article 6 of the Treaty on European Union, and the "Charter of Fundamental Rights of the European Union" (2000), everyone has the right to liberty and security and everybody who has been charged with a criminal offence shall be presumed innocent until proved guilty according to law.

Recalling that the European Union respects the fundamental rights as described in the European Convention for the Protection of Human Rights and Fundamental Freedoms, of which all Member States are Parties, and in particular the provisions relating to freedom of expression, peaceful assembly and freedom of association;
