Various Member States (notably Belgium, Bulgaria, the Czech Republic, France, Italy, Poland, Portugal, Romania and Sweden) referred to ‘the need to ensure that the labour market functions properly’ to justify restrictive measures, such as a limitative list of reasons for using agency workers (France, Italy, Poland), limitations on the number or proportion of agency workers who may be used in a user undertaking (Belgium, Italy), or the obligation for the employer to negotiate with a workers’ organisation before using agency workers (Sweden).

In that respect, the Court has already taken into consideration the fact that the body in question could not take the contested decision without taking account of the requirements of the public authorities (see, in particular, Van der Kooy, paragraph 37) or the fact that, apart from factors of an organic nature which linked the public undertakings to the State, those undertakings, through the intermediary of which aid had been granted, had to take account of directives issued by a Comitato Interministeriale per la Programmazione Economica (CIPE) (Case C-303/88 Italy v Commission, cited above, paragraphs 11 and 12; Case C-305/89 Italy v Commission, cited above, paragraphs 13 and 14).

For the purposes of transfers of quotas in Italy, Spain and the French overseas departments under restructuring plans as referred to in the second subparagraph of Article 12(2) of this Regulation, a group of sugar-producing undertakings having technical, economic and structural links and jointly and severally liable for their obligations under Community rules, particularly in respect of beet or cane growers, may be regarded as a sugar-producing undertaking.
Pour les transferts de quotas en Italie, en Espagne et dans les départements français d'outre-mer dans le cadre des plans de restructuration visés à l'article 12, paragraphe 2, deuxième alinéa, du règlement, peut être considéré comme entreprise productrice de sucre un groupe d'entreprises productrices de sucre liées entre elles sur le plan technique, économique et structurel et responsables solidairement des obligations, notamment à l'égard des producteurs de betteraves ou des producteurs de cannes, découlant pour elles de la réglementation communautaire.

1. Italy shall be authorised to grant adjustment aid, which may not exceed EUR 5,43 per 100 kilogrammes of white sugar to sugar beet producers and, where appropriate, to sugar producers for the production of the corresponding quantity of sugar effected within the A and B quotas of each sugar-producing undertaking, in the following regions: Abruzzi, Molise, Apulia, Sardinia, Campania, Basilicata, Calabria and Sicily.
