At the Transport Council meeting held on 26 March 2002, and with regard to the Regulation setting up the Joint Undertaking, as finally adopted on 21 May 2002, the Council and the Commission, on the one hand, and Belgium, on the other, made a declaration of commitment to exempt the Joint Undertaking and its staff from all taxes and social charges or similar obligations, to the extent that this was compatible with Community law and national law.
Lors du Conseil transport du 26 mars 2002 et à propos du règlement créant l'entreprise commune finalement adopté le 21 mai 2002, le Conseil et la Commission, d'une part, et la Belgique, d'autre part, ont fait une déclaration par laquelle ils s'engagent à exempter l'entreprise commune et son personnel de toutes taxes et charges sociales ou obligations similaires dans la mesure compatible avec le droit communautaire et le droit national.

3. Notes that the Joint Undertaking's final amended budget for the financial year 2012 included commitment appropriations of EUR 205,4 million and payment appropriations of EUR 167,9 million;

Takes note that the Joint Undertaking's final amending budget for the financial year 2011 included commitment appropriations of EUR 175 000 000 and payment appropriations of EUR 159 800 000; further acknowledges that the utilisation rates for commitment and payment appropriations were 94 % and 64 % respectively; calls for a detailed progress report on those shortcomings which makes specific proposals for a gradual improvement in utilisation rates;
1. observe que le budget rectificatif définitif de l'entreprise commune pour l'exercice 2011 comprenait 175 000 000 EUR en crédits d'engagement et 159 800 000 EUR en crédits de paiement; relève en outre que le taux d'exécution des crédits d'engagement et des crédits de paiement s'est établi respectivement à 94 % et à 64 %; demande qu'un rapport d'avancement détaillé sur ces insuffisances, présentant des propositions concrètes pour améliorer progressivement les taux d'utilisation, soit transmis au Parlement européen;

29. Notes that the Joint Undertaking has not amended its financial rules in order to reflect the changes brought by the new Financial Regulation and the framework financial regulation for the bodies referred to in Article 208 of the new Financial Regulation; acknowledges from the Joint Undertaking that it assessed the changes and proposed the amendments to its Governing Board; notes that in accordance with Article 5 of Council Decision 2007/198/Euratom, the Commission is to issue an opinion prior to submission of the final version of the financial rules to the Joint Undertaking’s Governing Board; calls on the Commission and the Joint Undertaking to remedy this issue without delay;

In accordance with the Statutes of the Joint Undertaking, the Governing Board of the Joint Undertaking approved the amendments to Decision 2007/198/Euratom proposed by the Commission.

In such a case and as long as such undertakings are in force, provisional duties imposed by the Commission in accordance with Article 7(1), or definitive duties imposed in accordance with Article 9(4), as the case may be, shall not apply to the relevant imports of the product concerned manufactured by the companies referred to in the Commission decision accepting undertakings, as subsequently amended.
