Reiterates once more the importance of the EU Member States working towards the fulfilment of the indivisibility and universality of human rights and supporting the work of the UNHRC in this respect, in particular by ratifying all the international human rights instruments that this body has established; reiterates its regret that no EU Member State has ratified the Convention on the Protection of the Rights of all Migrant Workers and Members of their Families; reiterates, too, its regret that several Member States have not yet adopted and/or ratified the Convention for the Protection of All Persons from Enforced Disappearance or the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and that only two Member States have ratified the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights; reiterates its call for all the Member States to ratify these conventions and protocols, and encourages them to sign and ratify the recent Optional Protocol to the Convention on the Rights of the Child on a communications procedure, which was opened for signature in Geneva, Switzerland, on 28 February 2012; stresses the importance of the Member States submitting their periodic reports to the UN monitoring bodies in a timely manner;

Calls on the EU Member States to sign up to, and ratify, all core UN and Council of Europe human rights conventions and the optional protocols thereto, in particular the 1990 International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families, the International Convention for the Protection of All Persons from Enforced Disappearance, the United Nations Declaration on the Rights of Indigenous Peoples of 13 September 2007, the 1998 ILO Declaration on Fundamental Principles and Rights at Work, the Council of Europe's framework convention for the protection of national minorities, the European Charter for Regional or Minority languages, the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights, the Optional Protocols to the Convention on the Rights of the Child and the United Nations Convention on the Rights of Persons with Disabilities; insists that the Optional Protocol to the Convention should be regarded as an integral part thereof, and calls for simultaneous accession to the latter (Convention and Protocol) ;

To the Optional Protocol a declaration of the European Community is added with respect to Article 12(1) of the Optional Protocol which indicates the competences that are transferred to the Community by the Member States under the Treaty establishing the European Community, in the areas covered by the Optional Protocol.

In light of the fact that Canada has always played an international leadership role in protecting children involved in armed conflicts, a role that has included negotiating the optional protocol to the Convention on the Rights of the Child on the involvement of children in armed conflicts, and in light of the specific commitments made by Canada and the United States in ratifying the optional protocol, the information available on Omar Khadr's recruitment by a group linked to al-Qaeda and the fact that he was 15 when he allegedly engaged in combat and was captured and originally detained, the subcommittee is of the opinion that Mr. Khadr should be considered “a child involved in armed conflict” and therefore should enjoy the protection set out in the optional protocol.

Only after this analysis is completed will Canada be in a position to make a decision as to whether to become a party to the optional protocol. b) Owing to the extensive consultations required and the complexities of the issues raised by the implementation of the optional protocol, no timeline has been developed for Canada to become a party to the optional protocol. c) The government is committed to actively considering whether Canada should become a party to the instrument.
