The European Commission decided today to refer Poland to the Court of Justice of the EU for failure to notify complete transposition (partial non-transposition) of EU rules on collective management of copyright and related rights, and multi-territorial licensing of rights in musical works for online use (Directive 2014/26/EU) into national law.
La Commission européenne a décidé aujourd'hui de saisir la Cour de justice de l'Union européenne d'un recours contre la Pologne pour manquement à l'obligation de notifier la transposition complète en droit national (non-transposition partielle) des dispositions de l'UE concernant la gestion collective du droit d'auteur et des droits voisins et l'octroi de licences multiterritoriales de droits sur des œuvres musicales en vue de leur utilisation en ligne (directive 2014/26/UE).

The territory of the Republic of Poland

(a) the term “Poland” means the Republic of Poland and, when used in a geographical sense, means the territory of the Republic of Poland, and any area adjacent to the territorial sea of the Republic of Poland within which, under the laws of Poland and in accordance with international law, the rights of Poland with respect to the exploration and exploitation of the natural resources of the seabed and its sub-soil may be exercised;

By way of derogation from Article 1, Ireland, Spain, Croatia, Cyprus, Latvia, Poland, Portugal, Romania, Slovak Republic, Finland, Sweden and the United Kingdom may authorise the placing on their market of traditionally smoked meat and smoked meat products, smoked in their territory and intended for consumption in their territory with levels of PAHs higher than those set out in point 6.1.4. of the Annex, provided that those products comply with the maximum levels applicable before 1 September 2014, i.e. 5,0 μg/kg for benzo(a)pyrene and 30,0 μg/kg for the sum of benzo(a)pyrene, benz(a)anthracene, benzo(b)fluoranthene and chrysene.

If a person’s occupational disease reoccurs or worsens while that person is residing in the territory of Canada and subject to the legislation of Canada, the competent institution of the Republic of Poland will readjust the amount of the benefit in accordance with the legislation of the Republic of Poland, provided the type of work performed in the territory of Canada did not contribute to the worsening or reoccurrence of the disease.

Where the legislation of the Republic of Poland requires that the occupational disease be first diagnosed in the territory of the Republic of Poland, this requirement shall also be fulfilled if the disease is first diagnosed in the territory of Canada.

as regards the Republic of Poland, the territory of the Republic of Poland, and

(a) subject to the existing provisions of the law of Canada regarding the deduction from tax payable in Canada of tax paid in a territory outside Canada and to any subsequent modification of those provisions – which shall not affect the general principle hereof – and unless a greater deduction or relief is provided under the laws of Canada, tax payable in Poland on profits, income or gains arising in Poland shall be deducted from any Canadian tax payable in respect of such profits, income or gains; and
