The ECB’s competence to deliver an opinion is based on Articles 127(4) and 282(5) of the Treaty on the Functioning of the European Union since the proposed regulation contains provisions affecting the tasks of the European System of Central Banks (ESCB) to promote the smooth operation of payment systems and to contribute to the smooth conduct of policies relating to the stability of the financial system, as referred to in the fourth indent of Article 127(2), and Article 127(5) of the Treaty.

Firmly believes that the financing of the Union budget should return to a genuine system of own resources, as provided for in the Treaty of Rome and all successive EU treaties; deeply regrets the fact that the current system, whereby the vast majority of the financing comes from national contributions, is non-transparent and unfair and is not subject to parliamentary control at either European or national level; stresses that such a system violates, in essence, the letter and spirit of the Treaty;

As a Janus Member – half constitutional, half budgetary – I would like today to speak a little more specifically about Mrs Guy-Quint’s report on the new budget system and about the impact that the Treaty of Lisbon will have on this new system. As has been said, it is above all a more democratic system.

Furthermore, it is important to ensure close cooperation and appropriate coordination between the ESS and the European System of Central Banks (ESCB), notably to foster the exchange of confidential data between the two systems for statistical purposes, in the light of Article 285 of the Treaty and of Article 5 of the Protocol (No 18) on the Statute of the European System of Central Banks and the European Central Bank annexed to the Treaty.

(31) Since the objectives of the action to be taken, namely the establishment and regulation of a joint information system, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the action, be better achieved at the level of the European Union, the Council may adopt measures in accordance with the principle of subsidiarity, as set out in Article 5 of the EC Treaty and referred to in Article 2 of the EU Treaty. In accordance with the principle of proportionality as set out in Article 5 of the EC Treaty, this Decision does not go beyond what is necessary to achieve those objectives.

However, the EU attaches particular importance to China not only bringing its legislative, regulatory and administrative structures into line with WTO standards, but also improving social conditions in the field of employment relations. To that end, there should be dialogue between the EU and China at all levels. Notes that the European Parliament has no say in connection with China's entry into the WTO system. Given the resulting democratic deficit and the economic implications of China's accession to the WTO system for the whole of Europe and the world, that is a shortcoming which the Treaty of Nice did not remedy, and which it will be essential to remedy by means of future changes to the Treaty.

Whereas, in particular, the use of Articles 100 and 235 of the Treaty as legal bases for this Decision is justified to the extent that the Agreement establishing the World Trade Organization, including the Annexes thereto, affects Council Directive 90/434/EEC of 23 July 1990 on the common system of taxation applicable to mergers, divisions, transfers of assets and exchanges of shares concerning companies of different Member States (1), Council Directive 90/435/EEC of 23 July 1990 on the common system of taxation applicable in the case of parent companies and subsidiaries of different Member States (2), which are based on Article 100 of the Treaty, and Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (3), which is based on Article 235 of the Treaty;
