2. Without prejudice to Directive 95/46/EC, the sponsor may ask the subject or, where the subject is not able to give informed consent, his or her legally designated representative at the time when the subject or the legally designated representative gives his or her informed consent to participate in the clinical trial to consent to the use of his or her data outside the protocol of the clinical trial exclusively for scientific purposes.
2. 9. Fishing effort deployed in the framework of scientific research by a vessel carrying a fishing gear or gears subject to a fishing effort regime or operating in a fishery subject to a fishing effort regime in a geographical area subject to that fishing effort regime shall be counted against the maximum allowable fishing effort related to such fishing gear or gears or such fishery and to such geographical area of its flag Member State if the catches taken during the deployment of this effort are marketed and sold insofar as they exceed 2 % of the fishing effort allocated.

L’effort de pêche déployé dans le cadre de la recherche scientifique par un navire détenant un ou plusieurs engins de pêche faisant l’objet d’un régime de gestion de l’effort de pêche ou opérant dans une pêcherie faisant l’objet d’un tel régime dans une zone géographique relevant de ce régime est imputé sur l’effort de pêche maximal autorisé applicable à l’État membre dont il bat pavillon pour cet engin ou ces engins de pêche ou cette pêcherie et cette zone géographique, si les captures effectuées lors du déploiement de cet effort sont commercialisées et vendues, dès lors qu’elles sont supérieures à 2 % de l’effort de pêche alloué.
