On 15 November 2012, the Commission notified Sri Lanka pursuant to Article 32 of the Regulation (EC) No 1005/2008 that it considered the possibility of identifying Sri Lanka as a non-cooperating third country and invited Sri Lanka to establish an action plan in close cooperation with its services to rectify the shortcomings identified in the Decision of 15 November 2012.

Expresses concern at the impact of the renewed conflict on reconstruction and the delivery of international aid, noting that although the EU has allocated almost EUR 125 million in post-tsunami humanitarian and reconstruction aid for Sri Lanka, the enduring political gridlock on the 'Post-Tsunami Operations Management Structure' continues to delay the release of a further EUR 50 million in aid, hindering vital reconstruction work in the north and east of Sri Lanka; notes also the decision of the Asian Development Bank to reschedule some funding and the difficulties in taking forward many infrastructure projects;

Is worried at the fact that a deal to share international aid has still not been implemented, and believes that aid sent to Sri Lanka by the EU, and other international donors, in response to the tsunami must benefit the victims of that disaster without regard for their ethnic or religious denomination; but is concerned about the distribution and use of tsunami funds, which have not had the expected impact on the everyday lives of the victims or on Sri Lanka's recovery; notes that the political gridlock on the 'Post-Tsunami Operations Management Structure' has already delayed the release of a further EUR 50 million in aid, hindering reconstruction work in the North and East of Sri Lanka;

Acknowledges the bold steps taken by the Government of Sri Lanka and the LTTE to create the conditions in which negotiations may lead to a political solution and a lasting peace, on the basis of the Oslo Declaration of December 2002, where the Government of Sri Lanka and the LTTE agreed to explore a solution based on a federal structure within a united Sri Lanka;
