(b) Subject to the provisions of Sections (b) and (c) of Article 3 of this Annex, each sponsoring member shall share with the other sponsoring members in losses under guarantees of sponsored investments, when and to the extent that such losses cannot be covered out of the Sponsorship Trust Fund referred to in Article 2 of this Annex, in the proportion which the amount of maximum contingent liability under the guarantees of investments sponsored by it bears to the total amount of maximum contingent liability under the guarantees of investments sponsored by all members.

(c) Upon the expiry of any guarantee covering an investment sponsored by a member, the liability of that member shall be decreased by an amount equivalent to the amount of such guarantee; such liability shall also be decreased on a pro rata basis upon payment by the Agency of any claim related to a sponsored investment and shall otherwise continue in effect until the expiry of all guarantees of sponsored investments outstanding at the time of such payment.

5. Where the reporting Member State, taking into account considerations expressed by the other Member States concerned, finds that the application dossier is not complete, or that the clinical trial applied for does not fall within the scope of this Regulation, it shall inform the sponsor thereof through the EU portal and shall set a maximum of ten days for the sponsor to comment on the application or to complete the application dossier through the EU portal.
5. Si l’État membre rapporteur , compte tenu des observations formulées par les autres États membres concernés, estime que le dossier de demande n’est pas complet ou que l’essai clinique sollicité n’entre pas dans le champ d’application du présent règlement, il en informe le promoteur par le biais du portail de l’Union et l’invite à formuler ses observations sur la demande ou à compléter le dossier de demande par le biais du portail de l’Union dans un délai maximal de dix jours.

4. Where the reporting Member State, taking into account considerations expressed by the other Member States concerned, finds that the application does not concern an aspect covered by Part I of the assessment report or that the application dossier is not complete, it shall inform the sponsor thereof through the EU portal and shall set a maximum of ten days for the sponsor to comment on the application or to complete the application dossier through the EU portal.
4. Si l'État membre rapporteur, tenant compte des observations formulées par les autres États membres concernés, estime que la demande ne se rapporte par à un aspect relevant de la partie I du rapport d'évaluation ou que le dossier de demande n'est pas complet, il en informe le promoteur par le biais du portail de l'Union et l'invite à formuler ses observations sur la demande ou à compléter le dossier de demande par le biais du portail de l'Union dans un délai maximal de dix jours.

That Member State shall make the inspection report available to the sponsor of the relevant clinical trial and shall submit the inspection report through the Union portal to the Union database. When making the inspection report available to the sponsor, the Member State concerned shall ensure that confidentiality is protected.

The sponsor of a clinical investigation shall submit an application to the Member State(s) in which the investigation is to be conducted accompanied by the documentation referred to in Chapter II of Annex XIV. Within 14 days after receipt of the application, the Member State concerned shall notify the sponsor whether the clinical performance study falls within the scope of this Regulation and whether the application is complete.

The sponsor of a clinical investigation shall submit an application to the Member State(s) in which the investigation is to be conducted accompanied by the documentation referred to in Chapter II of Annex XIV. Within six days after receipt of the application, the Member State concerned shall notify the sponsor whether the clinical investigation falls within the scope of this Regulation and whether the application is complete.

A Member shall not lose his or her place on the List for the Consideration of Private Members’ Business by virtue of sponsoring a Senate public bill or a private bill, but no Member may sponsor more than one such bill during a Parliament.
