Brussels, 20 December 2011 - The European Commission has approved under EU state aid rules the split-up of Westdeutsche Landesbank (WestLB), which will lead to sale and eventual winding down of its banking activities.

Within this "platform model" the German Government intends to allow for individual solutions for particular banks, e.g. the announced abolishment of both, Anstaltslast and Gewährträgerhaftung, for Bayerische Landesbank and the planned split of Westdeutsche Landesbank into two entities, one of them being restricted to public service functions and continuing to benefit from State guarantees, and the other entity carrying out normal banking business and not benefiting from State support anymore.
Au sein de ce modèle global, le gouvernement allemand entend aussi aménager des solutions spécifiques à certaines banques. On citera comme exemple la suppression aussi bien de la Gewährträgerhaftung que de l'Anstaltslast pour la Bayerische Landesbank et la scission programmée de la Westdeutsche Landesbank en deux entités, dont la première exercera exclusivement une mission de service public et, à ce titre, continuera à bénéficier des garanties d'État, tandis que l'autre, chargée d'opérations bancaires normales, sera désormais exclue de ce régime d'aides.
