2. The Member State which sighted the non-Contracting Party vessel shall attempt to inform such a vessel without delay that it has been sighted or by other means identified as engaging in fishing activities in the Convention Area and unless its flag state has been accorded the status of co-operating non-Contracting Party by NEAFC, is consequently presumed to be undermining the NEAFC conservation recommendations established under the Convention.

3. In the case of a non-Contracting Party vessel sighted or by other means identified as engaging in transhipment activities, the presumption of undermining conservation and enforcement measures applies to any other non-Contracting Party vessel that has been identified as having engaged in such activities with that vessel.

5. A Member State which receives a sighting report reporting the activities of a fishing vessel flying its flag from the competent authority of a contracting party of a regional fisheries management organisation shall notify the report and all relevant information as soon as possible to the Commission or to the body designated by it, which shall thereupon forward this information to the Executive Secretary of the regional fisheries management organisation concerned for further action in accordance with the measures adopted by this organisation, as appropriate.

(l) "sighting": means any sighting of a vessel flying the flag of a non-Contracting Party to the Convention by a vessel flying the flag of a Contracting Party to the Convention and operating in the Convention area, or by an aircraft registered in a Contracting Party to the Convention, and overflying the Convention area, or by a CCAMLR inspector;
l) "repérage": toute observation d'un navire battant pavillon d'une partie non contractante faite par un navire de pêche battant le pavillon d'une partie contractante à la convention et qui opère dans la zone de la convention, par un avion immatriculé dans une partie contractante à la convention et qui survole la zone de la convention ou par un inspecteur CCAMLR;

In the case of transhipment activities inside or outside the Convention area, involving the participation of a sighted non-Contracting Party vessel, the presumption that the effectiveness of the CCAMLR conservation measures has been undermined shall apply to any other non-Contracting Party vessel which was engaged in those activities with that vessel.

(i) "non-Contracting Party vessel": means a fishing vessel which flies the flag of a non-Contracting Party to the Convention and which has been sighted engaging in fishing activities in the Convention area;

Article 2a Fishing vessels of the Contracting Parties which operate in the NAFO Regulatory Area may, if they wish, record sightings, which can be reported to the inspection vessels so that the latter are able to proceed to a formal sighting.

(b) "sighting": any observation of a Non-Contracting Party vessel made by a vessel flying the flag of a Contracting Party to the CCAMLR Convention and operating in the Convention area, or by an aircraft registered in a Contracting Party to the CCAMLR Convention, and overflying the Convention Area or by an inspector of the fishery control services of the Contracting Parties assigned to the CCAMLR Inspection System;
