Urges the Cambodian authorities to revoke the arrest warrant for, and drop all charges against, opposition leader Sam Rainsy and CNRP members of the National Assembly and Senate, including Senator Hong Sok Hour; calls for the immediate release of the five human rights defenders still in preventive custody, namely Ny Sokha, Nay Vanda, Yi Soksan, Lim Mony and Ny Chakra, for these politicians, activists and human rights defenders to be allowed to work freely without fear of arrest or persecution, and for an end to political use of the courts to prosecute people on politically motivated and trumped-up charges; calls on the National Assembly to reinstate Sam Rainsy, Um Sam An and Hong Sok Hour immediately and to restore their parliamentary immunity.

whereas Articles 105(2) and 108 of the Constitution of the Republic of Poland state that a deputy or a senator shall not be subject to criminal accountability without the consent of the Sejm or of the Senate respectively.

Article 7c(1) of the same act states, in turn, that the motion for expression of consent for bringing a deputy or a senator to criminal accountability shall be submitted to the Speaker of the Sejm or to the Speaker of the Senate, who shall forward the motion to the body competent for its examination pursuant to the rules of procedure of the Sejm or the Senate and at the same time inform the deputy or senator concerned of the content of the motion.

A final comment on the procedures that enable the national parliaments to check that legislative proposals are in line with the principle of subsidiarity: the text of the report takes account of the reasoned opinions issued by the Portuguese Assembly, the Italian Senate and the Polish Senate, including the Polish Senate’s request for compliance with the obligation under Article 5 of the Protocol on subsidiarity, which provides for the inclusion in the legislative text of ‘a detailed statement making it possible to appraise compliance with the principles of subsidiarity and proportionality’.

Under the American system of advice and consent, the US Senate does not attempt a critical evaluation of the candidate but simply votes to accept or reject the nomination (The Senate, which has to act within a strict timetable, can also reconsider its decision within a couple of days, on a proposal from a Senator who voted with the majority.) The vote takes place in public unless the Senate decides otherwise (Even in the exceptional circumstances of a closed vote, any Senator can choose to publicise his or her vote.) Attractively simple as the US system is, if the EU Constitution continues to insist on collegial rather than individual approval of the Commission the European Parliament is obliged to continue to try to advise on each candidate in order to inform its final, collective consent. But this does not necessarily mean that the Parliament cannot follow the approach of the Senate in setting out its views on individual members of the college by a vote rather than by a statement.
