Welcomes the fact that the Government of Vietnam has issued a call for public input into its first constitutional reform since 1992 and that the deadline has now been extended until September 2013, but regrets that the public consultation has led to sanctions and pressure against those who legitimately express their opinions; hopes that the new Constitution addresses the issues of civil and political rights and religious freedoms as a priority; welcomes in this respect the opening of a dialogue with human rights organisations; expresses its hope that this can lead to important reforms on labour, education and human rights over a longer term; recommends that an invitation be addressed to the UN Special Rapporteur on Freedom of Expression and Opinion to visit the country and that the authorities fully implement any recommendations;

seven conventions on human rights, including prohibition of genocide and torture, protection of the rights of children, elimination of discrimination against women and minorities', protection of freedom of expression and association, the right to a fair trial, and judicial independence, as well as economic, social and cultural rights; eight fundamental conventions of the International Labour Organisation (ILO), including conventions prohibiting forced and child labour, ensuring workers' rights to freedom of association and collectively organise and bargain, and two conventions that protect workers from discrimination at work, and ensure that women and men receive the same remuneration for work of equal value; eight conventions on environmental protection and climate change, including monitoring of hazardous waste and harmful pollutants, safeguarding of biodiversity and endangered species, as well as UN commitments to tackle climate change; four conventions on good governance, namely the UN Convention against Corruption and three UN conventions seeking to control illegal drugs.

In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Facilitate dialogues on how to apply existing international law in cyberspace and promote the Budapest Convention to address cybercrime; · Support the promotion and protection of fundamental rights, including access to information and freedom of expression, focusing on: a) developing new public guidelines on freedom of expression online and offline; b) monitoring the export of products or services that might be used for censorship or mass surveillance online; c) developing measures and tools to expand Internet access, openness and resilience to address censorship or mass surveillance by communication technology; d) empowering stakeholders to use communication technology to promote fundamental rights; · Engage with international partners and organisations, the private sector and civil society to support global capacity-building in third countries to improve access to information and to an open Internet, to prevent and counter cyber threats, including accidental events, cybercrime and cyber terrorism, and to develop donor coordination for steering capacity-building efforts; · Utilise different EU aid instruments for cybersecurity capacity building, including assisting the training of law enforcement, judicial and technical personnel to address cyber threats; as well as supporting the creation of relevant national policies, strategies and institutions in third countries; · Increase policy coordination and information sharing through the international Critical Information Infrastructure Protection networks such as the Meridian network, cooperation among NIS ...

44. Deeply regrets restrictions on freedom of expression, assembly and association in the Sahel; expresses particular concern at reports in Chad of the harassment, intimidation and arrest of journalists, political opponents, trade unionists, church figures and other civil society activists and human rights defenders; expresses further concern at the arrest of and alleged violence against peaceful protesters in Mauritania, and the alleged attempts to silence opposition in Mali, including through the arrest of journalists and political opponents, and by censoring media outlets; stresses, in this connection, the importance in the Sahel of supporting human rights defenders, independent civil society, including women’s organisations, and a free media as key actors in the life of a democratic society, particularly in times of elections; welcomes positive developments on the freedom of expression, assembly and association elsewhere in the region, and encourages the EU to work with local partners to continue encouraging improvements; calls, furthermore, on the EU to encourage and assist a mapping of civil society as a basis for more effective support; recommends that the EU assist civil society and human rights defenders strategically as well as financially, opening up long-term exchanges, including through the relevant EU delegations;
44. déplore profondément les restrictions de la liberté d'expression, de réunion et d'association au Sahel; se dit particulièrement préoccupé par les informations provenant du Tchad faisant état de harcèlement, d'intimidations et d'arrestations de journalistes, d'opposants politiques, de syndicalistes, d'hommes d'église et d'autres militants de la société civile et défenseurs des droits de l'homme; exprime également son inquiétude face aux arrestations et aux allégations de violences à l'encontre de manifestants pacifiques en Mauritanie, et face aux tentatives de réduire l'opposition au silence au Mali, notamment en arrêtant des journalistes et des opposants politiques et en censurant les médias; souligne, dans ce contexte, l'importance de soutenir, dans la région du Sahel, les défenseurs des droits de l'homme, la société civile indépendante y compris les associations de femmes, et les médias libres, qui sont des acteurs essentiels de la vie d'une société démocratique, particulièrement en période électorale; se félicite des évolutions positives constatées en matière de liberté d'expression, de réunion et d'association dans le reste de la région et encourage l'Union européenne à collaborer avec ses partenaires locaux afin de continuer d'encourager les améliorations; appelle en outre l'Union à encourager et à participer au recensement de la société civile, afin d'améliorer l'efficacité du soutien apporté; recommande que l'Union aide la société civile et les défenseurs des droits de l'homme sur le plan stratégique mais aussi financier, en mettant sur pied des échanges à long terme, notamment par l'intermédiaire des délégations de l'Union compétentes;

2. For processing carried out for journalistic purposes or the purpose of academic artistic or literary expression, Member States shall provide for exemptions or derogations from Chapter II (principles), Chapter III (rights of the data subject), Chapter IV (controller and processor), Chapter V (transfer of personal data to third countries or international organisations), Chapter VI (independent supervisory authorities), Chapter VII (cooperation and consistency) and Chapter IX (specific data processing situations) if they are necessary to reconcile the right to the protection of personal data with the freedom of expression and information.
2. Dans le cadre du traitement réalisé à des fins journalistiques ou à des fins d'expression universitaire, artistique ou littéraire, les États membres prévoient des exemptions ou des dérogations au chapitre II (principes), au chapitre III (droits de la personne concernée), au chapitre IV (responsable du traitement et sous-traitant), au chapitre V (transfert de données à caractère personnel vers des pays tiers ou à des organisations internationales), au chapitre VI (autorités de contrôle indépendantes), au chapitre VII (coopération et cohérence) et au chapitre IX (situations particulières de traitement) si celles-ci sont nécessaires pour concilier le droit à la protection des données à caractère personnel et la liberté d'expression et d'information.

21. Is concerned about the wide margin of interpretation and application allowed by the Anti-Terror Law and the Criminal Code, in particular in cases where membership of a terrorist organisation has not been proven and where an act or statement is deemed to coincide with the aims of a terrorist organisation; expresses concern regarding continuing reports of torture and ill-treatment in police stations and in prisons, the excessive use of force by police officers during demonstrations and the lack of progress in bringing State officials to justice for alleged human rights abuses; urges Turkey to review the Anti-Terror Law as a matter of priority and to comply rigorously with its international human rights obligations by amending its relevant legislation; welcomes the decision to provide judges and prosecutors with in-service training on freedom of expression and freedom of the press and on the fundamental role of the European Court of Human Rights; urges the Government of Turkey to provide systematic adequate training to its police on the case law of the European Court of Human Rights; emphasises the need to set up an effective police complaint mechanism; would welcome further measures to improve direct access to Turkish courts by individual citizens in defence of their rights in order to reduce the number of cases filed at the European Court of Human Rights in Strasbourg;
21. s'inquiète de la grande marge d'interprétation et d'application autorisée par la loi antiterrorisme et par le code pénal, notamment dans les cas où l'appartenance à une organisation terroriste n'a pas été prouvée et quand une action ou une déclaration est réputée coïncider avec les objectifs d'une organisation terroriste; exprime sa préoccupation face aux rapports persistants faisant état de torture et de mauvais traitements dans les postes de police, de recours excessif à la force par les officiers de police lors des manifestations et de manque de progrès dans la traduction en justice des fonctionnaires accusés de violations des droits de l'homme; exhorte la Turquie à faire de la révision de la loi antiterrorisme une priorité et à se conformer strictement à ses obligations en matière de droits de l'homme en modifiant la législation concernée; se félicite de la décision de fournir aux juges et aux procureurs une formation au travail sur la liberté d'expression, sur la liberté de la presse et sur le rôle fondamental de la Cour européenne des droits de l'homme; invite le gouvernement de la Turquie à offrir systématiquement une formation adéquate à ses services de police, conformément à la jurisprudence de la Cour européenne des droits de l'homme; insiste sur la nécessité de mettre sur pied un mécanisme de recueil des plaintes sur la police; apprécierait des mesures supplémentaires visant à améliorer l'accès direct aux tribunaux turcs par les citoyens pour la défense de leurs droits et afin de réduire le nombre d'affaires portées devant la Cour européenne des droits de l'homme à Strasbourg;

Nor should the collective management organisation be allowed to apply deductions to the rights revenue collected on behalf of another collective management organisation, other than deductions in respect of management fees, without the express consent of the other organisation.

These include strengthening democracy and the rule of law, the reform of the judiciary and the fight against corruption and organised crime; respect of human rights and fundamental freedoms, including freedom of media and expression, rights of minorities and children, gender equality, trade union rights and other core labour standards, and fight against the practice of torture and prevention of ill-treatment; support for the development of civil society; and co-operation with the International Criminal Court.
