Sometimes, Member States take into account how much time has elapsed since the previous conviction was handed down, served, remitted or statute-barred (DK, NL, SE, SI).

It should be noted here that the Council Framework Decision of 6 December 2001 amending Framework Decision 2000/383/JHA on increasing protection by criminal penalties and other sanctions against counterfeiting in connection with the introduction of the euro [65] requires each Member State to recognise the principle of the recognition of previous convictions under the conditions prevailing under its domestic law and, under those same conditions, shall recognise for the purpose of establishing habitual criminality final sentences handed down in another Member State for the offences referred to in the Framework Decision.
A cet égard, il faut noter que la décision-cadre du Conseil du 6 décembre 2001 modifiant la décision-cadre 2000/383/JAI visant à renforcer par des sanctions pénales et autres la protection contre le faux-monnayage en vue de la mise en circulation de l'euro [65], prévoit que chaque Etat membre admet le principe de la récidive dans les conditions établies par sa législation nationale et reconnaît, dans lesdites conditions, comme génératrices de récidive les condamnations définitives prononcées par un autre Etat membre du chef de l'une des infractions prévues dans la décision-cadre.
