The Commission has consulted on the question of rights management since the mid-nineties and has published a series of documents, communications and papers addressing this issue, followed by public consultations (inter alia in 2004, 2007, 2009 and 2011).

15. Calls on the Council to enhance the role of the Human Rights Unit of its General Secretariat by allowing it to be involved in the conduct of the political dialogues, including the dialogues and consultations based on cooperation agreements under the responsibility of the Commission, and to set up, within its Human Rights Unit, a permanent coordination system for each structured human rights dialogue or consultation, in order to ensure the innovativeness of the dialogue and consultation topics, the selection of relevant participants and continuity, proceeding on the basis that such coordination should contribute to the establishment of bilateral networks of organisations, institutions and academics between Europe and the country in question, so as to ensure the requisite mainstreaming of human rights and democracy in all EU policies, especially following the reforms of the financial instruments for external EC aid; calls, to that end, for the necessary steps to be taken to enable the unit to perform the above tasks, including an increase in financial resources and personnel;
15. demande au Conseil d'accroître le rôle de l'unité "Droits de l'homme" de son secrétariat général, en lui permettant de participer à la conduite des dialogues politiques, y compris les dialogues et consultations fondés sur des accords de coopération sous la responsabilité de la Commission, ainsi que d'instituer à l'intérieur de cette unité un système de coordination permanent pour chaque dialogue ou consultation structurés, afin d'assurer le renouvellement des thèmes traités, la sélection des participants intéressés et la continuité, étant entendu que cette coordination doit contribuer à l'établissement de réseaux bilatéraux d'organisations, d'institutions et d'universitaires entre l'Europe et le pays en question, de façon à intégrer comme il se doit les droits de l'homme et la démocratie dans toutes les politiques de l'Union, notamment à la suite de la réforme des instruments financiers d'aide communautaire extérieure; demande, à cet effet, que soient prises les mesures nécessaires pour que l'unité puisse remplir les missions évoquées ci-dessus, et notamment un renforcement de ses ressources financières et de ses effectifs;

Calls on the Council to set clear criteria for the initiation, suspension or termination of a dialogue or consultation, to conduct an impact assessment before giving the reasons for their initiation or suspension (dealing with its expected period and the steps to be taken in order to restart the dialogue and consultation) and to make sure that the delegation of the country in question does not perceive the EU as viewing the dialogue or consultation as an end in itself that must be maintained at all costs;
31. demande au Conseil de définir des critères clairs pour engager, suspendre ou mettre fin à un dialogue ou des consultations, d'effectuer une analyse d'impact avant de donner les raisons pour engager ou suspendre le dialogue (portant sur la durée envisagée et sur les mesures à prendre pour relancer le dialogue ou les consultations) et de veiller à ce que la délégation du pays considéré ne perçoive pas le dialogue noué par l'UE comme une fin en soi, à poursuivre à tout prix;

If consultation has already been initiated by a Member State and another Member State which is called upon to support the same transaction questions the first-mentioned State as to its final position, failure to reply to such questioning on the expiry of a period of five working days shall authorise the enquiring Member State to consider that the Member State thus questioned has supported the matter on the terms indicated during consultation.
