Bulgaria adopted a law on conflicts of interest in 2009 and set up an administrative authority to establish and sanction conflicts of interest.[87] The establishment of a dedicated commission to establish conflicts of interest and to suggest sanctions has led to an impressive increase of public signals on conflicts of interest and a number of decisions, but so far only one case has been finalised.[88] The assessment of the Commission's first 15 months of operation shows a new authority that has taken up its challenge and started work quickly, but which has not yet been able to prove itself in convincing decisions in important cases.[89] Questions must also be raised regarding the effectiveness of the law on conflicts of interest.
La Bulgarie a adopté en 2009 une loi sur les conflits d’intérêts et a mis en place une autorité administrative chargée de déceler et de sanctionner les conflits d’intérêts[87]. La création d’une commission spécialisée pour identifier les conflits d’intérêts et proposer des sanctions a donné lieu à une médiatisation impressionnante des affaires de conflits d’intérêts, mais jusqu’à présent, une seule affaire a débouché sur une décision définitive[88]. L’évaluation des 15 premiers mois d’activité de cette commission montre une nouvelle autorité qui a relevé le défi et commencé rapidement à travailler, mais qui n’est pas encore en mesure de s’affirmer par des décisions convaincantes dans des affaires importantes[89]. This solution would have the advantage of preventing not only positive conflicts of jurisdiction (where two or more Member States want to hear a particular case) but also negative conflicts (where no Member States wants to hear it). In some cases, however (crimes against national interests, breaches of national security legislation, etc.), Member States will be unwilling to surrender jurisdiction, regardless of where the offences in question were committed.

Considers that the purpose of the Court of Auditors' audit was to give an answer to two questions: firstly, were adequate policies and procedures in place, and secondly, were those policies and procedures adequately implemented; notes, furthermore, that the Court based its work on the definition of conflict of interest as provided for in the Organisation for Economic Co-operation and Development (OECD) guidelines, and that the reference framework for minimum requirements adopted by the Court was also derived from those guidelines; stresses however that, although the OECD guidelines offer an international benchmark on this matter, they basically relate to conflicts of interests in the framework of public sector employees and cannot, therefore, provide an adequate basis for an effective response in the case of potential conflicts of interests among the governing bodies and other bodies involved inthe agencies' work, such as management boards and expert panels; nevertheless recognises the value of the OECD's toolkit, and especially the checklist for gifts and benefits, etc., as well as the recommendations made concerning penalties, the need to check the completeness and content of statements of interests and the requirement to harness expertise and identify potential conflicts of interest;

Where a question arises as to whether a choice-of-court agreement in favour of a court or the courts of a Member State is null and void as to its substantive validity, that question should be decided in accordance with the law of the Member State of the court or courts designated in the agreement, including the conflict-of-laws rules of that Member State.
