5. The European Parliament and the Council, acting in accordance with the ordinary legislative procedure and after consulting the Economic and Social Committee and the Committee of the Regions, may also adopt incentive measures designed to protect and improve human health and in particular to combat the major cross-border health scourges, measures concerning monitoring, early warning of and combating serious cross-border threats to health, and measures which have as their direct objective the protection of public health regarding tobacco and the abuse of alcohol, excluding any harmonisation of the laws and regulations of the Member States.
5. Council Directive 89/391/EEC [43] on the introduction of measures to encourage improvements in the safety and health of workers at work, in particular Directive 98/24/EC [44]on the protection of the health and safety of workers from the risks related to chemical agents at work and Council Directive 89/656/EEC [45] on the minimum health and safety requirements for the use by workers of personal protective equipment at the workplace, have created conditions for improvements in the safety of workers and operators.

‘parametric value’ means the value of radioactive substances in water intended for human consumption above which Member States shall assess whether the presence of radioactive substances in water intended for human consumption poses a risk to human health which requires action and, where necessary, shall take remedial action to improve the quality of water to a level which complies with the requirements for the protection of human health from a radiation protection point of view.

In the event that monitoring of water intended for human consumption indicates non-compliance with a parametric value, the Member State concerned should consider whether that poses a risk to human health which requires action and, where necessary, take remedial action to improve the quality of the water to a level which complies with the requirements for the protection of human health from a radiation protection point of view.

Since the Community is competent to adopt the basic safety standards for the protection of the health of workers and general public against the dangers arising from ionising radiations, the provisions of this Directive supersede those of Directive 98/83/EC as regards the requirements for the protection of the health of the general public with regard to radioactive substances in water intended for human consumption.

Food law shall pursue one or more of the general objectives of a high level of protection of human life and health and the protection of consumers' interests, including fair practices in food trade, taking account of, where appropriate, the protection of animal health and welfare, plant health and the environment.

(10) In accordance with the principle of proportionality, the measures provided for in this Directive are strictly limited to the minimum needed to achieve the objective of the proper functioning of the internal market; where action at Community level is necessary, and in order to guarantee an area which is truly without internal frontiers as far as electronic commerce is concerned, the Directive must ensure a high level of protection of objectives of general interest, in particular the protection of minors and human dignity, consumer protection and the protection of public health; according to Article 152 of the Treaty, the protection of public health is an essential component of other Community policies.
(10) Conformément au principe de proportionnalité, les mesures prévues par la présente directive se limitent strictement au minimum requis pour atteindre l'objectif du bon fonctionnement du marché intérieur. Là où il est nécessaire d'intervenir au niveau communautaire, et afin de garantir un espace qui soit réellement sans frontières intérieures pour le commerce électronique, la directive doit assurer un haut niveau de protection des objectifs d'intérêt général, en particulier la protection des mineurs, de la dignité humaine, du consommateur et de la santé publique. Conformément à l'article 152 du traité, la protection de la santé publique est une composante essentielle des autres politiques de la Communauté.
