The home Member State may make an issuer subject to requirements more stringent than those laid down in this Directive, except that it may not require issuers to publish periodic financial information on a more frequent basis than the annual financial reports referred to in Article 4 and the half-yearly financial reports referred to in Article 5’.

‘1a. By way of derogation from paragraph 1, the home Member States may require issuers to publish additional periodic financial information on a more frequent basis than the annual financial reports referred to in Article 4 and the half-yearly financial reports referred to in Article 5, where the following conditions are met:
«1 bis. Par dérogation au paragraphe 1, l’État membre d’origine peut imposer aux émetteurs de publier des informations financières périodiques complémentaires sur une base plus fréquente que les rapports financiers annuels visés à l’article 4 et les rapports financiers semestriels visés à l’article 5 lorsque les conditions suivantes sont réunies:

Member States should not be allowed to impose in their national legislation the requirement to publish periodic financial information on a more frequent basis than annual financial reports and half-yearly financial reports.
Les États membres ne devraient pas être autorisés à imposer, dans leur législation nationale, la publication d’informations financières périodiques sur une base plus fréquente que les rapports financiers annuels et les rapports financiers semestriels.

However, Member States should nevertheless be able to require issuers to publish additional periodic financial information if such a requirement does not constitute a significant financial burden, and if the additional information required is proportionate to the factors that contribute to investment decisions.

The directive obliges Member States to publish periodic financial information on their income throughout the financial year, in addition to continuous information concerning the possession of significant percentages of voting rights.
