On 15 November 1995 the United States was granted a renewal of that waiver to 30 September 2005, and again on 29 May 2009 to 31 December 2014, to the extent necessary to permit the United States to provide duty-free treatment for imports of eligible products originating in beneficiary Central American and Caribbean countries and territories (‘beneficiary countries’) designated pursuant to the provisions of the Caribbean Basin Economic Recovery Act of 1983 as amended by the Caribbean Basin Economic Recovery Expansion Act of 1990 and by the United States-Caribbean Basin Trade Partnership Act, the Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2006, the Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2008 (‘existing waiver’).

Pursuant to paragraph 3 of Article IX of the WTO Agreement, the United States submitted a request to extend the existing waiver to 31 December 2019 and expand the scope of the existing waiver of its obligations under paragraph 1 of Article I of the GATT 1994 to the extent necessary to permit the United States to provide duty-free treatment to eligible products originating in beneficiary countries designated pursuant to the provisions of the Caribbean Basin Economic Recovery Act of 1983 as amended by the Caribbean Basin Economic Recovery Expansion Act of 1990 and by the United States-Caribbean Basin Trade Partnership Act, the Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2006, the Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2008, and the Haitian Economic Lift Program Act of 2010.

(i) the total fair market value at that time of all fixed interests of a particular class in the trust held by the beneficiary, persons or partnerships not dealing at arm’s length with the beneficiary, or persons or partnerships that acquired their interests in the trust in exchange for consideration given to the trust by the beneficiary, is at least 10% of the total fair market value at that time of all fixed interests of the particular class, or

(iii) where the property is, immediately before that beneficiary’s death, a partnership interest described in subparagraph (9.3)(c)(iii) (other than a partnership interest to which subsection 100(3) applies), and the trust further elects, in its return of income under this Part for the taxation year in which the beneficiary died, to have this subparagraph apply to the trust in respect of the property,

(d) where at a particular time a taxpayer who is a beneficiary of a trust or a member of a partnership has received, is entitled to receive or can reasonably be expected to receive government assistance, non-government assistance or a contract payment, the amount thereof that may reasonably be considered to be in respect of, or for the acquisition of, depreciable property of the trust or partnership or in respect of an expenditure by the trust or partnership shall be deemed to have been received at that time by the trust or partnership, as the case may be, as government assistance, non-government assistance or as a contract payment in respect of the property or the expenditure, as the case may be.

(2.1) For the purposes of paragraph 12(1)(x), where at a particular time a taxpayer who is a beneficiary of a trust or a member of a partnership has received an amount as an inducement, whether as a grant, subsidy, forgivable loan, deduction from tax, allowance or any other form of inducement, in respect of the activities of the trust or partnership, or as a reimbursement, contribution, allowance or as assistance, whether as a grant, subsidy, forgivable loan, deduction from tax, allowance or any other form of assistance, in respect of the cost of property or in respect of an expense of the trust or partnership, the amount shall be deemed to have been received at that time by the trust or partnership, as the case may be, as such an inducement, reimbursement, contribution, allowance or assistance.

Participation in the award of procurement or grant contracts financed under this Regulation shall be open to all natural persons who are nationals of or legal persons who are established in a Member State of the European Union, a country that is or has been defined as beneficiary of assistance in an Action Programme adopted under the present Regulation, a country that is beneficiary of the Instrument of Pre-Accession or the European Neighbourhood and Partnership Instrument, or a non-EU Member State of the European Economic Area.

Participation in the award of procurement or grant contracts financed under this Regulation shall be open to all natural persons who are nationals of and legal persons who are established in a Member State, a country that is a beneficiary of this Regulation, a country that is a beneficiary of the European Neighbourhood and Partnership Instrument, or a Member State of the European Economic Area.

The Partnership is implemented by bilateral Association Agreements between the EU and each of the partner countries.[vii] Building on this platform, the ENP offers to these countries an increasingly close relationship with the EU, involving a significant degree of economic integration and a deepening of political cooperation in an approach founded on partnership, joint ownership and differentiation and aiming to promote the prosperity, stability and security of Europe’s immediate neighbours.[viii] All five north African countries are beneficiaries under this policy, implementation of which started in 2005 with the adoption of a first set of ENP Action Plans, including those for Tunisia and Morocco, which representing the fruit of discussions with the partner countries and common agreement on priority reform priorities and actions.
Ce partenariat est mis en œuvre au moyen d’accords d'association bilatéraux entre l'UE et chacun des pays partenaires.[vii] Se fondant sur cette plate-forme, la PEV offre à ces pays des relations de plus en plus étroites avec l’UE, qui incluent un important niveau d’intégration économique et un approfondissement de la coopération politique dans le cadre d’une approche fondée sur le partenariat, l’appropriation commune et la différentiation, et qui visent à promouvoir la prospérité, la stabilité et la sécurité des voisins immédiats de l’Europe.[viii] Chacun des cinq pays nord-africains bénéficie de cette politique, dont la mise en œuvre a commencé en 2005 par l'adoption d'un premier ensemble de plans d'action PEV, notamment en faveur de la Tunisie et du Maroc, qui sont le fruit de discussions avec les pays partenaires et d'un accord commun sur les mesures et réformes prioritaires.
