WHEREAS by chapter seventy-four of the statutes of Canada, 1923, and by chapter three hundred and seventy-nine of the laws of the state of New York, 1922, two companies were incorporated under the name of Buffalo and Fort Erie Public Bridge Company, with authority to construct, maintain and operate a bridge across the Niagara River between the city of Buffalo, in the state of New York, and the village (now the town) of Fort Erie, in the province of Ontario, and by agreement dated thirteenth day of June, 1925, the said two companies were amalgamated and consolidated so as to form one and a new single company under the same name in accordance with, and subject to, the provisions of the said Acts of incorporation; and whereas for the purpose of the reorganization and refinancing of the said bridge undertaking upon a basis which will permit of a considerable reduction of fixed charges and consequent reduction of tolls now charged, by an Act of the Legislature of the state of New York, being chapter eight hundred and twenty-four of the laws of the said state for 1933, (hereinafter called “Act of Incorporation”, and a copy of which is, for the information only of Parliament, attached as a Schedule hereto), a Board, known as the Buffalo and Fort Erie Public Bridge Authority, was created a body corporate and politic, constituting a public benefit corporation, with power to acquire, hold and manage the property and assets of the Buffalo and Fort Erie Public Bridge Company; and whereas by the Act of Incorporation it is provided that the said Board shall consist of nine members, six of whom are required to be citizens of the United States and residents of the state of New York, to be appointed and removed by the Governor of the said state, and three of whom are required to be residents of the Dominion of Canada, to be appointed and removed as may be determined by the Government of the Dominion of Canada; and whereas the Buffalo and Fort Erie Public Bridge Company has by its ...

In the few cases where a Member was found guilty of one of these charges (in some instances only after the Parliament in which they were charged had been dissolved), only one Member resigned his seat (see Debates, May 30, 1989, p. 2321); the others chose either not to seek re-election or were defeated in the following general election.

Last, but not least, the possible consequence of losing the mandate of Member of the European Parliament (under the Polish law on elections to the European Parliament, if Mr Tomczak is convicted of committing the alleged offence, he will lose his seat) could not have been envisaged at the time when the charges were brought against Mr Tomczak (as he was a Member of Sejm at that time and the relevant Act relating to members of the national parliament does not contain provisions providing for disqualification in such circumstances).

As regards the reference to Parliament’s contribution, certain points were highlighted on all of these occasions in the conclusions linked to individual reports and speeches: the need first of all to harmonise transport charges in all Member States to consolidate the single European market; the opportunity for a transformation – if not a radical one in some cases, then one that is objective and realistic at all times and, in any case, challenging – of the charging structure with a view to internalising the external costs of transport, which are often overlooked when decisions are made concerning the transport mode and, therefore, omitted from infrastructure completion strategies.

I do not object to the current bill because it is an amendment to an incorporation which Parliament enacted in 1947, as I did not object in the past to amendments to other corporations sole incorporated by the Parliament of Canada in a more distant past; indeed, at a time when some of the Western Canadian provinces were not part of Canada and the federal government and the federal Parliament were charged with the obligation to proceed with incorporation when requests were made.
