The model decision attached to the Interinstitutional Agreement of 25 May 1999 between the European Parliament, the Council and the Commission, and, as regards Commission officials, Decision 1999/396, both of which concern the terms and conditions for internal investigations in relation to the prevention of fraud, corruption and any illegal activity detrimental to the Communities’ interests, merely require, in the second paragraph of Article 4, that the Secretary-General of the institution must agree that the obligation to invite the person concerned to give his views may be deferred where the needs of the investigation require.
La décision modèle annexée à l’accord interinstitutionnel du 25 mai 1999 entre le Parlement européen, le Conseil et la Commission et, pour ce qui concerne les fonctionnaires de la Commission, la décision 1999/396, toutes deux relatives aux conditions et modalités des enquêtes internes en matière de lutte contre la fraude, la corruption et toute activité illégale préjudiciable aux intérêts des Communautés, exigent seulement, dans leur article 4, paragraphe 2, que le secrétaire général de l’institution donne son accord à ce que l’obligation d’entendre l’intéressé soit différée lorsque les besoins de l’enquête l’exigent.

The European Parliament and the Council welcome the Commission's commitment rapidly to consider enhancing the transparency of the remuneration policies, total remuneration paid, including any contingent or deferred compensation, and benefits in kind granted to each member of administrative, management or supervisory bodies under its Action Plan for ‘Modernising Company Law and Enhancing Corporate Governance in the European Union’ of 21 May 2003 and the Commission's intention to make a Recommendation on this topic in the near future.
Le Parlement européen et le Conseil accueillent favorablement l'engagement pris par la Commission d'envisager rapidement d'accroître la transparence en matière de politique de rémunération, de montant total des rémunérations versées, y compris les rémunérations conditionnelles ou différées, et d'avantages en nature accordés à chaque membre d'organes d'administration, de direction et de surveillance, dans le cadre de son plan d'action du 21 mai 2003 intitulé «Modernisation du droit des sociétés et renforcement du gouvernement d'entreprise dans l'Union européenne», ainsi que l'intention de la Commission de présenter une recommandation sur ce sujet dans un avenir proche.
