Y. whereas a Special Report is the last resort of the European Ombudsman for dealing with cases of maladministration by institutions, bodies, offices or agencies of the Union; whereas the Ombudsman should further explore her political powers and develop the instruments available to her;

No doubt can be cast on that conclusion by the applicant’s arguments concerning a hypothetical right of candidates in a competition to have access to their marked written tests, based on the Ombudsman’s recommendation to the Commission of 18 October 1999, on acceptance of that recommendation by the Commission and on the Ombudsman’s inquiry, commenced in 2005, which ended in a further recommendation to the Commission regarding the latter’s obligation to provide information regarding the evaluation criteria to any candidates who request it.

A high level of awareness was further found regarding the right to make a complaint to the Commission, the European Parliament and the Ombudsman (87%, +2 points compared to 2007) and to have the same treatment as a national in any Member State (85%, +2 points compared to 2007).

Notes with satisfaction that in many cases European authorities have taken action to settle a complaint once they are made aware of the problem concerned and that in other cases a friendly solution has been achieved; continues to urge the relevant Community authorities to comply with the Ombudsman's draft recommendations to remedy cases of maladministration following an inquiry and to follow up the Ombudsman's further critical remarks in order to prevent similar cases of maladministration arising in the future;
