The transmission of any information about an individual or any business or industrial secret made in accordance with this Agreement, or in accordance with any arrangement for the implementation of this Agreement, shall be governed by the respective national laws concerning the protection of data.

4. This Directive does not affect national law concerning the presence of legal counsel during any stage of the criminal proceedings, nor does it affect national law concerning the right of access of a suspected or accused person to documents in criminal proceedings.
