Contributions raised by the participating Member States in accordance with Articles 103 and 104 of Directive 2014/59/EU of the European Parliament and of the Council and transferred to the Fund by virtue of Article 3(3) of the agreement on the transfer and mutualisation of contributions to the Single Resolution Fund as referred to in point (36) of Article 3(1) of Regulation (EU) No 806/2014 (‘the Agreement’) should be incorporated in the calculation of individual contributions and hence deducted from the amount due by each institution.

25. Considers that the transfer of a business to the employees through the creation of a cooperative and other forms of employee ownership could be the best way of ensuring the continuity of an enterprise; stresses that this kind of transfer of businesses to employees, in particular with regard to worker cooperatives and worker buy-outs, should be supported by a specific EU budget line that also includes financial instruments; calls urgently for the creation, with the participation of the European Investment Bank (EIB) and the social partners, and with stakeholders from the cooperative movement, of a European mechanism designed to promote the development of cooperatives and, in particular, business transfers under the cooperative form, also through, for example, the instrument of mutualisation funds;

If during the transitional period, as laid down in the Agreement, recoupments of the non-mutualised part are not sufficient to permit the funding of the establishment by the Member State concerned of its national financial arrangement in accordance with Directive 2014/59/EU, recoupments shall also include the totality or a part of the part of the compartment corresponding to that Member State subject to mutualisation in accordance with the Agreement or otherwise, after the transitional period, the totality or a part of the contributions transferred by the Member State concerned during the close cooperation, in an amount sufficient to permit the funding of that national financial arrangement.
Si, au cours de la période transitoire, fixée dans l'accord, les récupérations de la part non mutualisée ne sont pas suffisantes pour permettre à l'État membre concerné de financer la mise en place de son dispositif de financement national conformément à la directive 2014/59/UE, les récupérations incluent également la totalité ou une partie de la part du compartiment correspondant à cet État membre faisant l'objet d'une mutualisation conformément à l'accord ou autrement, après la période transitoire, la totalité ou une partie des contributions transférées par l'État membre concerné au cours de la coopération rapprochée, pour un montant suffisant pour permettre le financement dudit dispositif de financement national.

3. By way of derogation from paragraph 1 of this Article, decisions referred to in Article 50(1), which involve the raising of ex-post contributions in accordance with Article 71, on voluntary borrowing between financing arrangements in accordance with Article 72, on alternative financing means in accordance with Article 73 and Article 74, as well as on the mutualisation of national financing arrangements in accordance with Article 78, exceeding the use of the financial means available in the Fund, shall be taken by a majority of two thirds of the Board members, representing at least 50 % of contributions during the eight-year transitional period until the Fund is fully mutualised and by a majority of two thirds of the Board members, representing at least 30 % of contributions from then on.

Par dérogation au paragraphe 1 du présent article, les décisions visées à l'article 50, paragraphe 1, concernant la perception de contributions ex post conformément à l'article 71, les emprunts volontaires entre dispositifs de financement conformément à l'article 72, les moyens de financement alternatifs conformément aux articles 73 et 74, ainsi que la mutualisation des dispositifs nationaux de financement conformément à l'article 78, au-delà des moyens financiers disponibles dans le Fonds, sont prises à la majorité des deux tiers des membres du CRU représentant au moins 50 % des contributions pendant la période transitoire de huit ans avant la pleine mutualisation du Fonds, et à la majorité des deux tiers des membres du CRU représentant au moins 30 % des contributions après cette période.

Provisions on the interaction between different resolution funds (mutualisation and voluntary mutual borrowing and lending) also fully apply between the Single Resolution Fund and national resolution funds of non-participating Member States.

The Fund should be financed by bank contributions raised at national level and should be pooled at Union level in accordance with an intergovernmental agreement on the transfer and progressive mutualisation of those contributions (the ‘Agreement’), thus increasing financial stability and limiting the link between the perceived fiscal position of individual Member States and the funding costs of banks and undertakings operating in those Member States.
