...[+++]ve rights to exhibit motion pictures may rely upon those provisions against a national tax authority which refuses to permit it to make a VAT declaration in which that person seeks to deduct the VAT component of the goods and services used for the purposes of producing the films in question from the VAT which should have been included in the price charged on the assignment of those rights; (3) The failure of a taxable person to add the value of the output tax at the time of calculating the price of the assignment of exclusive rights to exhibit motion pictures cannot affect the right of that taxable person, who has made the assignments in question, to deduct from the VAT which he ought to have paid in respect of those assignments the VAT component of the goods and services supplied to him for the purposes of making the motion pictures that were the subject-matter of the assignments.Il proposait à la Cour de répondre de la manière suivante: «1) La cession de droits de diffusion cinématographique

...[+++] de la directive 77/388 qu'une personne qui fournit des prestations taxables relatives à des droits exclusifs de diffusion cinématographique peut invoquer ces dispositions à l'encontre d'une administration fiscale nationale qui refuse de l'autoriser à effectuer une déclaration de TVA, par laquelle cette personne souhaite déduire la TVA affectant les biens et services utilisés pour produire les films en cause, de la TVA qui aurait due être incluse dans le prix facturé pour la cession de ces droits. 3) Le fait qu'un assujetti n'ajoute pas la valeur de la taxe en aval au moment du calcul du prix de cession des droits exclusifs de diffusion cinématographique ne peut pas avoir d'incidence sur le droit de cet assujetti, qui a effectué les cessions en cause, de déduire de la TVA qu'il aurait dû payer pour ces cessions, la TVA affectant les biens et les services qui lui ont été fournis aux fins de la production des films qui constituent l'objet des cessions».
