The airport managing body may require that suppliers of groundhandling services and self-handling airport users establish and implement a safety management system commensurate with the size of the undertaking and the nature and complexity of the activities, is compatible with the management systems of the airport operator, and complies with any other safety requirements set down in national or Union law.

– (PT) My vote is intended above all to highlight three points that I believe are crucial: firstly, what is known as ‘self-handling’, must not be surreptitiously subverted, opening the door to all types of opportunism and market distortion. Instead, it should properly be restricted to the ship’s own crew and undertaken in conjunction with the competent port operator; secondly, the system of pilotage in ports must be kept outside the scope of the directive and reserved for national legislation; thirdly, it is crucial that the way is opened for clear rules on State aid in this field to be properly defined, as suggested during the debates on the Green Paper and on which, regrettably, the text of the directive still says very little.

(11) Whereas for certain categories of groundhandling services access to the market and self-handling may come up against safety, security, capacity and available-space constraints; whereas it is therefore necessary to be able to limit the number of authorized suppliers of such categories of groundhandling services; whereas it should also be possible to limit self-handling; whereas, in that case, the criteria for limitation must be relevant, objective, transparent and non-discriminatory;

Where at an airport, specific constraints of available space or capacity, arising in particular from congestion and area utilization rate, make it impossible to open up the market and/or implement self-handling to the degree provided for in this Directive, the Member State in question may decide:

(14) Whereas in certain cases these constraints can be such that they may justify restrictions on market access or on self-handling to the extent that these restrictions are relevant, objective, transparent and non-discriminatory;
