The Standing Senate Committee on Official Languages met this day at 6:30 p.m. to study Bill S-14, An Act to amend the National Anthem Act to reflect the linguistic duality of Canada; to study and report upon the operation of the Official Languages Act, and of regulations and directives made thereunder, within those institutions subject to the Act, as well as upon the reports of the Commissioner of Official Languages, the President of the Treasury Board and the Minister of Canadian Heritage; to conduct the clause-by-clause consideration of Bill S-11, An Act to amend the Official Languages Act (promotion of English and French).

In 1976, he upheld the constitutionality of the Bourassa government's Bill 22 establishing French as the official language of Quebec; in 1978, he struck down a section of the Lévesque government's Bill 101, in order to affirm the equality of French and English in the National Assembly and in Quebec's courts; and, in 1982, he struck down another section of Bill 101 limiting access to English language education.

Ms Copps: I would suggest that, instead of taking the bill as is, as a number of interveners have raised certain question about it, including the Department of Justice, we would withdraw the bill in its current form and refer the bill and the proposed amendments to a subcommittee of the Joint Committee on Official Languages, to continue the process, bearing in mind that we would have to ensure, through proper legal language, et cetera, that whatever engagements we undertake we do in the context of what is legally binding to the Government of Canada and not to others.
Mme Copps: Je préconise que, au lieu d'adopter le projet de loi tel quel, puisqu'un certain nombre d'intervenants ont exprimé certaines réserves, en particulier le ministère de la Justice, on retire le projet de loi actuel et le renvoie, avec les amendements proposés, à un sous-comité du Comité mixte des langues officielles, afin d'y poursuivre le processus, en assurant que les engagements qui sont pris lient uniquement le gouvernement du Canada et non pas d'autres paliers, et ce en veillant à avoir un libellé en bonne et due forme.

Last week, the government accepted a legislative amendment concerning the national language which, according to the government, does not affect the minorities’ language use; however, the bill itself suggests otherwise.

Mr. Speaker, I am pleased to present a petition signed by nearly 400 people from Quebec City calling on the Government of Canada to pass Bill C-482, which requires the federal government to comply with the Charter of the French Language within the province of Quebec, and therefore to amend the Official Languages Act and include a provision in the Canada Labour Code requiring federally regulated companies to comply with Bill 101 in Quebec and make French the language of work.
