Furthermore, finding that Freixenet had indeed had the opportunity to submit its observations on the illustrations of the bottles mentioned in the decisions of the Fourth Board of Appeal, the Court held, at paragraph 48 of those judgments, that Freixenet was not therefore justified in pleading, in that regard, infringement of the second sentence of Article 73 of Regulation No 40/94.
Par ailleurs, constatant que Freixenet avait bien eu l’occasion de faire valoir ses observations sur les illustrations des bouteilles citées dans les décisions de la quatrième chambre de recours de l’OHMI, le Tribunal a jugé, aux points 48 de ces arrêts, qu’elle n’était donc pas fondée à invoquer, à cet égard, la violation de l’article 73, seconde phrase, du règlement nº 40/94.
