Without prejudice to national legislation concerning public access to documents, Member States shall ensure that the designated authorities and private bodies referred to in Article 12(1) do not disclose personal or individual information and data they obtain in their advisory activity to persons other than the farmer managing the holding concerned, with the exception of any irregularity or infringement found during their activity which is covered by an obligation laid down in Community or national law to inform a public authority, in particular in the case of criminal offences.
Sans préjudice de la législation nationale concernant l'accès du public aux documents, les États membres veillent à ce que les autorités désignées et les organismes privés visés à l'article 12, paragraphe 1, ne communiquent aucune information ou donnée personnelle ou individuelle qu'ils obtiennent dans le cadre de leur activité de conseil à des personnes autres que l'agriculteur assumant la gestion de l'exploitation concernée, sauf en cas d'irrégularité ou d'infraction constatée dans le cadre de leur activité pour laquelle la législation communautaire ou nationale prévoit l'obligation d'informer une autorité publique, en particulier en cas d'infraction pénale.

3. Where the competent authority has already informed the farmer of irregularities in the single application or where it has given notice to the farmer of its intention to carry out an on-the-spot check and where that on-the-spot check reveals irregularities, amendments in accordance with paragraphs 1 shall not be authorised in respect of the agricultural parcels affected by the irregularities.
3. Lorsque l'autorité compétente a déjà informé l'agriculteur des irrégularités que comporte la demande d'aide ou lorsqu'elle l'a averti de son intention de procéder à un contrôle sur place et que ce contrôle révèle des irrégularités, les modifications visées au paragraphe 1 ne sont pas autorisées pour les parcelles agricoles concernées par ces irrégularités.

However, where the competent authority has already informed the farmer of irregularities in the aid application or where the competent authority has given notice to the farmer of its intention to carry out an on-the-spot check and where that on-the-spot check reveals irregularities, withdrawals shall not be authorised in respect of the parts of the aid application affected by the irregularities.
Toutefois, lorsque l'autorité compétente a déjà informé l'agriculteur des irrégularités que comporte la demande d'aide ou lorsqu'elle l'a averti de son intention de procéder à un contrôle sur place et que ce contrôle révèle des irrégularités, les retraits ne sont pas autorisés pour les parties de la demande d'aide concernées par ces irrégularités.

2. The reductions and exclusions provided for in Chapter I shall not apply with regard to the parts of the aid application as to which the farmer informs the competent authority in writing that the aid application is incorrect or has become incorrect since it was lodged, provided that the farmer has not been informed of the competent authority's intention to carry out an on-the-spot check and that the authority has not already informed the farmer of any irregularity in the application.
2. Les réductions et exclusions prévues au chapitre I ne s'appliquent pas en ce qui concerne les parties de la demande d'aide que l'agriculteur a signalées par écrit à l'autorité compétente comme étant incorrectes ou l'étant devenues depuis l'introduction de la demande, à condition que l'agriculteur n'ait pas été prévenu que l'autorité compétente entendait effectuer un contrôle sur place, et n'ait pas été informé par l'autorité compétente des irrégularités constatées dans sa demande.

Farmers who give notice to the competent national authorities at any time of incorrect aid applications should not be subject to any reductions or exclusions irrespective of the reason of the incorrectness, provided that the farmer has not been informed of the competent authority's intention to carry out an on-the-spot check and the authority has not already informed the farmer of any irregularity in the application.
Il convient que les agriculteurs qui notifient à tout moment aux autorités nationales compétentes l'existence de demandes d'aide inexactes ne fassent pas l'objet de réductions ni d'exclusions quelle que soit la raison de l'inexactitude, pour autant qu'ils n'aient pas été informés de l'intention de l'autorité compétente de réaliser un contrôle sur place et que l'autorité compétente ne les ait pas encore informés d'irrégularités dans la demande.
