Position: Support the adoption of the proposed revision of Article 34 of the Convention to provide for a fixed time period (36 months) for the entry into force amendments to the Appendices adopted by the General Assembly, including the clause of flexibility to extend such deadline on a case-by-case basis, where so decided by the General Assembly by the majority provided for under Article 14 § 6 of COTIF.

2. The Commission shall be empowered to adopt delegated acts, in accordance with Article 36, to amend Annex IX to take into account amendments to the Combined Nomenclature affecting the products listed in that Annex.

The proposed compromise amendment splits Amendment 8 of the Draft Report into 2 amendments in the interest of clarity.

15 amendments tabled by Parliament were not incorporated into the Council’s common position, for reasons of legal coherence and legislative technique; clarity in technical terminology; practicality, feasibility or enforceability; as well as avoidance of imposing excessive administrative burdens on operators and national authorities. These amendments relate to the deletion of the title (amendment 51), the threshold levels for the adventitious or technically unavoidable presence of GMOs or of traces of materials produced from GMOs (amendments 26, 52 and 55), mixtures of GMOs (amendment 16) and the standardisation of procedures for the identification of transactions (amendment 50), the doubling of the time for which information must be kept (amendments 17 and 22), derived products (amendment 20), the transmission of information on products which are produced from GMOs but do not contain GMOs (amendment 21), the coexistence of national and Community systems for traceability (amendment 28), entry into force (amendments 32 and 33), deletion of the term ‘produced from GMOs’ (amendment 39) and the application of comitology under Regulation 178/2002/EC (amendment 48).

4. The proposal, adoption and entry into force of amendments to Annex A, B or C shall be subject to the same procedures as for the proposal, adoption and entry into force of additional Annexes to this Convention, except that an amendment to Annex A, B or C shall not enter into force with respect to any Party that has made a declaration with respect to amendment to those Annexes in accordance with paragraph 4 of Article 25, in which case any such amendment shall enter into force for such a Party on the 90th day after the date of deposit with the depository of its instrument of ratification, acceptance, approval or accession with respect to such amendment.
4. This amendment replaces amendment 4 of the draft report. It takes into account amendment 13 Frassoni/Voggenhuber and the fact that Article 2(2) of the Regulation gives the institutions the discretionary power to grant access to documents also to non-EU-citizens.
Le présent amendement, remplaçant l'amendement 4 du projet de rapport, est basé sur l'amendement 13 déposé par Monica Frassoni et Johannes Voggenhuber et tient compte du fait que l'article 2, paragraphe 2, du règlement (CE) n 1049/2001 permet aux institutions d'autoriser l'accès aux documents à des citoyens non européens.
