Unless otherwise specified in this title, this Regulation and the delegated acts adopted pursuant to this Regulation shall apply to applications for international registrations under the Protocol relating to the Madrid Agreement concerning the international registration of marks, adopted at Madrid on 27 June 1989 (hereafter referred to as ‘international applications’ and ’the Madrid Protocol’ respectively), based on an application for a European Union trade mark or on a European Union trade mark and to registrations of marks in the international register maintained by the International Bureau of the World Intellectual Property Organisation (hereafter referred to as ‘international registrations’ and ’the International Bureau’, respectively) designating the European Union '.
«Sauf si le présent titre en dispose autrement, le présent règlement et les actes délégués adoptés en vertu du présent règlement s'appliquent à toute demande d'enregistrement international déposée en vertu du protocole relatif à l'arrangement de Madrid concernant l'enregistrement international des marques, adopté à Madrid le 27 juin 1989 (ci-après dénommés respectivement »demande internationale« et »protocole de Madrid«), et fondée sur une demande de marque de l'Union européenne ou sur une marque de l'Union européenne , ainsi qu'à l'enregistrement, dans le registre international tenu par le Bureau international de l'Organisation mondiale de la propriété intellectuelle (ci-après dénommés respectivement »enregistrement international« et »Bureau international«), de marques désignant l'Union européenne ».

Unless otherwise specified in this title, this Regulation and the delegated acts adopted pursuant to this Regulation shall apply to applications for international registrations under the Protocol relating to the Madrid Agreement concerning the international registration of marks, adopted at Madrid on 27 June 1989 (hereafter referred to as ‘international applications’ and ‘the Madrid Protocol’ respectively), based on an application for a European Union trade mark or on a European Union trade mark and to registrations of marks in the international register maintained by the International Bureau of the World Intellectual Property Organisation (hereafter referred to as ‘international registrations’ and ‘the International Bureau’, respectively) designating the European Union'.

The national trade mark application or the designation of a Member State party to the Madrid Protocol [...] resulting from the conversion of the designation of the European Union through an international registration shall enjoy, in respect of the Member State concerned, the date of the international registration pursuant to Article 3(4) of the Madrid Protocol or the date of the extension to the European Union pursuant to Article 3ter(2) of the Madrid Protocol if the latter was made subsequently to the international registration, or the date of priority of that registration and, where appropriate, the seniority of a trade mark of that State claimed under Article 153'.

In order to ensure the effective and efficient registration of international trade marks in full consistency with the rules of the Protocol relating to the Madrid Agreement concerning the international registration of marks, the power to adopt delegated acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of specifying the details on the procedures concerning the international registration of trade marks.
Afin que les marques internationales puissent être enregistrées de manière efficace, efficiente et parfaitement conforme aux règles du protocole relatif à l'arrangement de Madrid concernant l'enregistrement international des marques, il convient de déléguer à la Commission le pouvoir d’adopter, conformément à l’article 290 du traité, des actes délégués précisant le détail des procédures d’enregistrement international des marques.

By adopting these acts, it will be possible for firms to profit from the advantages of the Community trade mark through the Madrid Protocol and vice versa by allowing Community trade mark applicants and holders of such trade marks to apply for international protection of their trade marks through the filing of an international application under the Madrid Protocol and, conversely, holders of international registrations under the Madrid Protocol to apply for protection of their trade marks under the Community trade mark system.

The Madrid Protocol introduces certain new features into the system of international registration of marks as existing under the Madrid Agreement Concerning the International Registration of Marks of 14 April 1891 (the "Madrid Agreement") and in particular states that intergovernmental organisations (such as the EC), having their own regional trade mark system, may adhere to the international registration system.
Le Protocole de Madrid introduit un certain nombre d'éléments nouveaux dans le système d'enregistrement international des marques mis en place par l'Arrangement de Madrid concernant l'enregistrement international des marques du 14 avril 1891 ("l'Arrangement de Madrid"), notamment en autorisant les organisations intergouvernementales qui possèdent leur propre système régional d'enregistrement de marques à participer au système d'enregistrement international.

Through the international registration of a mark at the WIPO International Bureau, the mark concerned will in principle be protected in any State or Intergovernmental Organisation which is a Contracting Party to the Madrid Protocol and which has been designated in the application for international registration.

According to the Commission proposal on the modification of the Community Trade Mark Regulation, international registrations designating the European Community shall be treated in the same way as applications for Community Trade Marks and, after protection has been granted to such registrations, registered as Community Trade Marks.
