Definition: The common themes that are shared by dissociative or conversion disorders are a partial or complete loss of the normal integration between memories of the past, awareness of identity and immediate sensations, and control of bodily movements. All types of dissociative disorders tend to remit after a few weeks or months, particularly if their onset is associated with a traumatic life event. More chronic disorders, particularly paralyses and anaesthesias, may develop if the onset is associated with insoluble problems or interpersonal difficulties. These disorders have previously been classified as various types of conversion hysteria . They are presumed to be psychogenic in origin, being associated closely in time with traumatic events, insoluble and intolerable problems, or disturbed relationships. Without prejudice to the provisions of this Directive, in particular those concerning the obligations relating to the advertising of awarded contracts and to the information to candidates and tenderers as set out in Article 30(3) and Article 35, and in accordance with the national law to which the contracting authority/entity is subject, in particular legislation regarding access to information, the contracting authority/entity, subject to contractually acquired rights, shall not disclose information forwarded to it by economic operators which such operators have designated as confidential; such information includes, in particular, technical or trade secrets and the confidential aspects of tenders.
Sans préjudice des dispositions de la présente directive, notamment celles relatives aux obligations en matière de publicité sur les marchés attribués et d’information des candidats et des soumissionnaires, figurant à l’article 30, paragraphe 3, et à l’article 35, et, conformément au droit national auquel sont soumis le pouvoir adjudicateur ou l’entité adjudicatrice, en particulier la législation relative à l’accès à l’information, ce dernier ou cette dernière ne divulguent pas, sous réserve des droits acquis par contrat, les renseignements que les opérateurs économiques leur ont communiqués à titre confidentiel; ces renseignements comprennent notamment les secrets techniques ou commerciaux et les aspects confidentiels des offres.

Taking into account that the Proposal sets forth new rules to be followed by OLAF to conduct investigations of alleged illegal activities, it is essential to ensure that in doing so, the data protection and privacy rights of the persons implicated in such investigations, suspected infringers and also staff members and other individuals who provide information to OLAF, are properly guaranteed. This is even more important given the particularly sensitive type of information that OLAF may potentially collect, which includes data relating to suspected offences, offences, criminal convictions, health data as well as information that would serve to exclude individuals from a right, benefit or contract insofar as such information represents a particular risk to the rights and freedoms of the data subjects.
Étant donné que la proposition énonce de nouvelles règles devant être respectées par l'OLAF dans la conduite d'enquêtes sur des allégations d'activités illégales, il est essentiel de s'assurer que les droits à la protection des données et au respect de la vie privée des personnes impliquées dans ces enquêtes, des contrevenants présumés ainsi que des membres du personnel et d'autres personnes fournissant des informations à l'OLAF sont garantis comme il se doit — et ce d'autant plus que l'OLAF est susceptible de collecter des informations d'une nature particulièrement sensible, à savoir des données relatives à des suspicions, des infractions et des condamnations pénales, des données relatives à la santé ainsi que des informations qui pourraient servir à exclure des personnes du bénéfice d'un droit, d'une prestation ou d'un contrat, dans la mesure où ces informations représentent un risque particulier pour les droits et les libertés des personnes concernées.
