Best practices for anticipating company restructuring and minimising their impact on workers and social conditions have been outlined today by the European Commission in the form of an EU Quality Framework for anticipation of Change and Restructuring (QFR).
La Commission européenne a présenté aujourd’hui le cadre de qualité de l’Union européenne pour l’anticipation des changements et des restructurations. Il définit des pratiques d’excellence pour agir en amont des restructurations d’entreprises et en limiter les effets sur les travailleurs et les incidences sociales.

1. Except in circumstances where restructuring is triggered by unforeseen or sudden events, any restructuring operation, in particular when it is likely to have a significant negative impact, is preceded by an appropriate preparation with the relevant stakeholders, according to their respective competences, concerned with a view to preventing or alleviating its economic, social and local impact.

Any restructuring operation, in particular those likely to have a negative impact on employment, is accompanied by an early explanation and justification to the relevant stakeholders before any practical measures are taken, irrespective of whether the restructuring operation is to be carried out on the basis of either long-term strategic goals and requirements or short-term constraints and whether the decision regarding restructuring is being taken by the company or by a group controlling the company.

Toute opération de restructuration, en particulier si elle risque d'avoir des incidences négatives sur l'emploi, est accompagnée d'une explication et d'une justification précoces à l'attention de toutes les parties prenantes concernées avant l'adoption de toute mesure concrète, indépendamment du fait que l'opération de restructuration doit avoir lieu sur la base d'objectifs et d'exigences stratégiques à long terme ou de contraintes à court terme et du fait que la décision de restructuration est prise par l'entreprise ou par un groupe qui la contrôle.

While recognising that one of the likely consequences of restructuring will be the abandonment of some non-viable national industrial capacities, stresses that any medium and long term plans for such restructuring should be aimed at having the least impact on employment; recommends, therefore, greater reorientation and synergies, based on more specialisation, interoperability and complementarity; calls for a better use of EU funding, such as the European Social Fund and European Globalisation Adjustment Fund, to support anticipation and adaptation to change;
