1. Any investigation or temporary withdrawal procedure initiated and not terminated under Regulation (EC) No 732/2008 shall be reinitiated automatically under this Regulation, except in respect of a beneficiary country of the special incentive arrangement for sustainable development and good governance under that Regulation if the investigation concerns only the benefits granted under the special incentive arrangement for sustainable development and good governance.

Toute enquête ou procédure de retrait temporaire ouverte en application du règlement (CE) no 732/2008 et non encore terminée est automatiquement rouverte conformément au présent règlement, sauf dans le cas d’un pays bénéficiaire du régime spécial d’encouragement en faveur du développement durable et de la bonne gouvernance en vertu dudit règlement si l’enquête ne porte que sur les bénéfices accordés au titre dudit régime spécial d’encouragement.

The rules governing investigation activities provide for a number of procedural guarantees regarding information from the Office for the institutions and persons concerned and the relevant authorities of the Member States.
Le dispositif réglementaire encadrant les activités d'enquête prévoit un certain nombre de garanties procédurales relatives à l'information, par l'Office, des institutions concernées et des personnes impliquées ou des autorités compétentes des Etats membres.

3. In case of breach or withdrawal of undertakings by any party, a definitive measure shall be imposed in accordance with Article 12, on the basis of the facts established within the context of the investigation which led to the undertaking, provided that the investigation was concluded with a final determination as to subsidisation and that the non-Community air carrier concerned, or the government granting the subsidy, has been given an opportunity to comment, except in the case of withdrawal of the undertaking by the non-Community air carrier or such government.
3. En cas de violation ou de rupture d'engagements par une partie, une mesure définitive est imposée conformément à l'article 12 sur la base des faits établis dans le contexte de l'enquête ayant abouti aux engagements, à condition que cette enquête se soit conclue par une constatation finale concernant la subvention et que le transporteur aérien non communautaire concerné ou les pouvoirs publics octroyant la subvention aient eu, sauf dans le cas de la rupture de leurs engagements, la possibilité de présenter leurs observations.

Recommendation 30: With a view to rendering investigations into cross-border organised crime more efficient, the Council is requested to work towards the approximation of national legislation on criminal procedure governing investigative techniques so as to make their use more compatible.
