The decision authorising the establishment of the EU Trust Fund for Colombia (EUTF) was adopted on 23 March 2016, with €70 million from the general budget of the European Union's Development Cooperation Instrument (DCI).

The main governing body of the Trust Fund for Colombia will be the Strategic Board, which defines its strategy, general objectives and thematic priorities. These will be adopted in the first board meeting, which will be held on 12 December, immediately after the signing of the Constitutive Agreement of the Trust Fund.

(a) subject to the existing provisions of the law of Canada regarding the deduction from tax payable in Canada of tax paid in a territory outside Canada and to any subsequent modification of those provisions — which shall not affect the general principle hereof — and unless a greater deduction or relief is provided under the laws of Canada, tax payable in Colombia on profits, income or gains arising in Colombia shall be deducted from any Canadian tax payable in respect of such profits, income or gains;

15.1 Pursuant to the Agreement Concerning Annual Reports on Human Rights and Free Trade Between Canada and the Republic of Colombia, the Minister shall cause to be laid before each House of Parliament by May 15 of each year or, if that House is not then sitting, on any of the 30 days next thereafter that it is sitting, a report on the operation of this Act during the previous calendar year, containing a general summary of all actions taken under the authority of this Act, and an analysis of the impact of these actions on human rights in Canada and the Republic of Colombia.

(b) subject to the existing provisions of the law of Canada regarding the allowance as a credit against Canadian tax of tax payable in a territory outside Canada and to any subsequent modification of those provisions — which shall not affect the general principle hereof — where a company which is a resident of Colombia pays a dividend to a company which is a resident of Canada and which controls directly or indirectly at least 10 per cent of the voting power in the first-mentioned company, the credit shall take into account the tax payable in Colombia by that first-mentioned company in respect of the profits out of which such dividend is paid; and

Colombia had earlier not wanted a political involvement by the Secretary General in the conflict of Colombia, but given the new peace process initiated by President Pastrana in 1998 and 1999, it took this step, and the Secretary General asked me to be his special adviser on the country.

(3) The alleged obstacle to trade was constituted by the general Colombian tax law of 1996 (as amended) (Estatuto Tributario), which provides for a distinction between vehicles assembled or manufactured in Colombia and those manufactured or assembled outside Colombia for the purposes of the application of VAT. This law stipulated that the vehicles in the category up to 1400 cc manufactured or assembled in Colombia are subject to a VAT rate of 20 % compared with a VAT rate of 35 % for imported cars.
