TRADUCTIONS EN CONTEXTE

1. In cases referred to in Article 40(5) of Regulation (EC) No 1782/2003, where the agri-environmental commitments referred to in that Article expire after the last date for lodging an application for payment under the single payment scheme in its first year of application, the Member State shall establish, in the first year of application of the single payment scheme, reference amounts for each farmer concerned in accordance with Article 40 (1), (2), (3) or (5) second subparagraph of that Regulation, provided that any double payment under those agri-environmental commitments is excluded.

Dans les cas visés à l'article 40, paragraphe 5, du règlement (CE) no 1782/2003, lorsque les engagements agroenvironnementaux visés dans ledit article expirent après la date limite d’introduction des demandes de paiement au titre du régime de paiement unique au cours de sa première année d'application, l’État membre établit, au cours de la première année d'application du régime de paiement unique, les montants de référence pour chaque agriculteur concerné conformément à l'article 40, paragraphes 1, 2, 3 ou 5, deuxième alinéa, dudit règlement, à condition que soit exclu tout double paiement au titre de ces engagements agro-environnementaux.

The main aim of the agri-environmental measure was to obtain sufficient experience in preparation and implementation of the agri-environmental programme post-accession which was accomplished, in particular in Slovakia and the Czech Republic.
La mesure en faveur d’actions agroenvironnementales avait pour objet de préparer la mise en œuvre du programme agroenvironnemental de postadhésion, objectif atteint en particulier en Slovaquie et en République tchèque.

Assistance also covers support for non-productive investments linked to the achievement of agri or forest-environmental commitments or the achievement of other agri-environmental objectives, as well as measures aimed at improving forestry resources with an environmental objective (support for the first afforestation of agricultural land, establishment of agroforestry systems or restoring forestry potential and preventing natural disasters).
Sont également concernées par l’aide, les mesures de soutien aux investissements non productifs liés à la réalisation des engagements agro ou sylvoenvironnementaux ou à l'atteinte d'autres objectifs agroenvironnementaux ainsi que les mesures visant à améliorer les ressources forestières dans un objectif environnemental (aide au premier boisement des terres, à l'installation de systèmes agroforestiers ou à la reconstitution du potentiel forestier et à la prévention des catastrophes naturelles).

In order to provide more flexibility for support which produces agri-environmental effects, Member States should be able to put an end to agri-environmental commitments and to make available equivalent support under the first pillar, on the condition that the economic interests and the legitimate expectations of the beneficiary are respected and the global environmental benefit is maintained.
Afin d'apporter une plus grande souplesse à l'aide qui produit des effets agroenvironnementaux, les États membres devraient pouvoir mettre un terme aux engagements en faveur de l'agroenvironnement et proposer une aide équivalente dans le cadre du premier pilier, pour autant que soient pris en compte les intérêts économiques et les attentes légitimes du bénéficiaire et que soient préservés les avantages pour l'environnement sur le plan mondial.

(2) To guarantee better implementation of the new programming period as regards agri-environmental measures, Member States should be allowed to authorise the transformation of an agri-environmental commitment contracted on the basis of the old rules into a new commitment of five years or more under Regulation (EC) No 1257/1999 provided that the new commitment is definitely beneficial to the environment.
(2) Pour assurer une meilleure mise en oeuvre de la nouvelle programmation en ce qui concerne les mesures agro-environnementales, il apparaît nécessaire de permettre aux État membres d'autoriser la transformation d'un engagement agro-environnemental contracté sur base de l'ancienne législation en un nouvel engagement de cinq ans ou plus dans le cadre du règlement (CE) n° 1257/1999, à condition que ce nouvel engagement constitue un bénéfice certain pour l'environnement.
