4. If the acquirer of any holding referred to in paragraph 3 is an investment firm, a credit institution, an insurance undertaking or a UCITS management company authorised in another Member State, or the parent undertaking of an investment firm, credit institution, insurance undertaking or a UCITS management company authorised in another Member State, or a person controlling an investment firm, credit institution, insurance undertaking or a UCITS management company authorised in another Member State, and if, as a result of that acquisition, the undertaking would become the acquirer's subsidiary or come under his control, the assessment of the acquisition shall be subject to the prior consultation provided for in Article 60.
4. Si l'acquéreur d'une participation visée au paragraphe 3 est soit une entreprise d'investissement, un établissement de crédit, une entreprise d'assurance ou la société de gestion d'OPCVM agréés dans un autre État membre, soit l'entreprise mère d'une entreprise d'investissement, d'un établissement de crédit, d'une entreprise d'assurance ou de la société de gestion d'OPCVM agréés dans un autre État membre, soit une personne contrôlant une entreprise d'investissement, un établissement de crédit, une entreprise d'assurance ou la société de gestion d'OPCVM agréés dans un autre État membre, et dès lors qu'à la suite de cette acquisition, l'entreprise ciblée deviendrait la filiale de l'acquéreur ou relèverait de son contrôle, l'évaluation de ladite acquisition fait l'objet de la consultation préalable prévue à l'article 60.

If the acquirer of the holding referred to in paragraph 1 is an investment firm, a credit institution or an insurance undertaking authorised in another Member State, or the parent undertaking of an investment firm, credit institution or insurance undertaking authorised in another Member State, or a natural or legal person controlling an investment firm, credit institution or insurance undertaking authorised in another Member State, and if, as a result of that acquisition, the undertaking in which the acquirer proposes to acquire a holding would become the acquirer's subsidiary or come under his control, the assessment of the acquisition must be subject to the prior consultation provided for in Article 6".
