Council Directive 80/987/EEC of 20 October 1980 relating to the protection of employees in the event of the insolvency of their employer, as amended by Directive 2002/74/EC of the European Parliament and of the Council of 23 September 2002, must be interpreted as precluding national legislation on the protection of employees in the event of the insolvency of their employer, such as that at issue in the main proceedings, under which a third-country national who is not legally resident in the Member State concerned is not to be regarded as an employee with the right to an insolvency benefit — on the basis, in particular, of claims relating to unpaid wages — in the event of his employer’s insolvency, even though that third-country national is recognised under the civil law of the Member State as having the status of an ‘employee’ with an entitlement to pay which could be the subject of an action against his employer before the national courts.

Welcomes Council Decisions 2007/779/EC, Euratom of 8 November 2007 establishing a Community Civil Protection Mechanism (4) and 2007/162/EC, Euratom of 5 March 2007 establishing a Civil Protection Financial Instrument (5), designed to improve the mobilisation and coordination of civil protection assistance in the event of major emergencies inside or outside the EU;

1. This Decision establishes a Civil Protection Financial Instrument (the Instrument) to support and complement the efforts of the Member States for the protection, primarily of people but also of the environment and property, including cultural heritage, in the event of natural and man-made disasters, acts of terrorism and technological, radiological or environmental accidents and to facilitate reinforced cooperation between the Member States in the field of civil protection.

La présente décision institue un instrument financier pour la protection civile («l'instrument»), destiné à soutenir et à compléter les efforts déployés par les États membres pour protéger principalement les personnes, mais aussi l'environnement et les biens, y compris le patrimoine culturel, en cas de catastrophes naturelles ou causées par les activités humaines, d'actes terroristes ou d'accidents technologiques, radiologiques ou environnementaux et à favoriser le renforcement de la coopération entre les États membres dans le domaine de la protection civile.

(1) The current Civil Protection Action Programme approved by Council Decision 1999/847/EC, of 9 December 1999, establishing a Community action programme in the field of civil protection(1), states, in its sixth recital, that the isolated and outermost regions of the Union have special characteristics because of their geography, terrain and social and economic conditions which have an adverse effect and make it difficult to deliver aid and means of assistance in the event of major danger.

In the present case, the Commission is of the view that, in the light of the SNCM’s stated asset shortfall (see above) and having regard to the possible civil liability arising on the part of the authorised liquidator in the event of failure to act under the law of 1985 and the creditors’ entitlement to bring an action since 2005, it is very likely that an action ‘en comblement de passif’ would be brought against the French State in the event of a liquidation of SNCM by the court (163).

(3) A mechanism to facilitate reinforced cooperation in civil protection assistance interventions could supplement the current Community action programme in the field of civil protection(7) by making support available in the event of major emergencies which may require urgent response action.
