If that person has done nothing wrong, if that person is in lawful possession of whatever goods we are talking about, and the court finds that it is appropriate to return those goods to that person who is innocent of any criminal wrongdoing, and if there is no other reason to keep that property, then why would you impose upon an innocent person some form of recognizance and put him or her on conditions such that, if at some point in time that recognizance is breached, that person effectively commits a criminal act under the Criminal Code and could be convicted of such and have a criminal record for something that is absolutely lawful?
