Other international legal instruments deal with children in conflict situation, in particular the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflicts[2], the Geneva Convention IV of 1949 relative to the Protection of Civilian Persons in time of war[3], the Protocols I + II Additional to the Geneva Convention of 1949 and relating to the Protection of Victims of Armed Conflicts[4], all of which recognise specific needs of protection for children, together with the Statute of the International Criminal Court which defines as a war crime the enrolment of children under the age of 15 in national armed forces or the use of them as active participants in hostilities[5].

16. Notes that the Agency's technical staff members need to be commonly recruited from national aviation authorities and the aviation industry; understands that the staff members must have sufficient and up-to-date technical experience of working in the field of aviation to perform a technical check of documents demonstrating compliance for the purposes of ensuring an adequate level of aviation safety as requested by the applicable Union legislation; is concerned however that this situation could cause conflicts of interest if a staff member recruited from an aircraft manufacturer works and takes decisions at the Agency on the certification of the aircraft he/she used to work on while employed by the manufacturer and, if not detected and adequately managed, could result in a conflict of interest situation; recognises however that the Agency has put in place a certification procedure where impartiality of the decision-making process is guaranteed through the collegiality of the technical assessments and the decision-making process itself; also understands that the Agency is in the process of setting up an Agency-wide policy in the area of codes of conduct including identification, prevention, monitoring and dealing with the consequences of potential conflict of interest cases which will help the Agency to further improve the identification and handling of conflict of interests situations in such a way that aviation safety is not put at risk at any time;
16. observe que l'Agence doit recruter généralement son personnel technique parmi le personnel des autorités aéronautiques nationales et de l'industrie aéronautique; comprend que les membres du personnel doivent disposer d'une expérience suffisamment longue et à jour sur le plan technique dans le domaine de l'aviation pour être en mesure d'effectuer la vérification technique des documents de certification en vue de garantir un degré de sécurité aérienne suffisant comme l'exige la législation applicable de l'Union; se déclare cependant préoccupé de ce qu'une telle situation puisse conduire à des conflits d'intérêts, si un agent employé auparavant par un constructeur d'aéronefs travaille à présent au sein de l'Agence et y prend des décisions quant à la certification d'aéronefs auxquels il a pu collaborer lorsqu'il était en poste auprès du constructeur, ce qui, si la situation n'est pas détectée et gérée comme il se doit, pourrait donner lieu à un conflit d'intérêts; reconnaît toutefois que l'Agence a mis en place une procédure de certification qui garantit l'impartialité du processus décisionnel par la collégialité des évaluations techniques et du processus décisionnel en tant que tel; comprend également qu'au sein de l'Agence, une politique en matière de codes de conduite couvrant l'ensemble de l'Agence est en cours de développement et qu'elle couvrira l'identification, la prévention, le suivi et la gestion des conséquences de conflits d'intérêts potentiels, ce qui permettra à l'Agence d'améliorer encore l'identification et la gestion des situations de conflits d'intérêts de telle sorte que la sécurité aérienne ne soit à aucun moment mise en danger;

19. Regrets the fact that the provisional organisation chart of the EEAS does not include all existing units dealing with crisis response planning and programming, conflict prevention and peacebuilding with the CSDP structures in line with the Madrid agreement; calls in this context for the organisation of regular meetings of a crisis management board to be composed of the CMPD, the CCPC, the EUMS, the EU SITCEN, the peace-building, conflict prevention, mediation and security policy units, the Chair of the PSC, the geographical desks and other policy departments concerned, placed under the authority of the VP/HR and the executive Secretary-General and with the participation of the Commission humanitarian aid, civil protection and internal security structures according to the circumstances; such meetings would be coordinated by the Managing Director for Crisis Response; calls on the VP/HR and the Commission to equip the board with an efficient alert and emergency system and a large unified operations room, located within the EEAS, so as to enable surveillance to be carried out 24 hours a day, 7 days a week, hence avoiding the present operational overlapping, which hardly squares with the need for a proper surveillance and rapid reaction system to deal with crises; considers that regular coordination and exchange should be ensured between this system and the European emergency response centre currently being developed by the Commission to guarantee appropriate synergies while respecting each other’s competencies;
19. déplore le fait que l'organigramme provisoire du SEAE ne comprenne pas toutes les unités chargées de la planification et de la programmation des interventions en cas de crise, de la prévention des conflits et de la consolidation de la paix dans les structures de la PSDC, conformément aux accords de Madrid; demande dans ce contexte que se réunisse, sur une base régulière, un conseil de gestion des crises, composé de la CMPD, de la CCPC, de l'EMUE, du SITCEN, des unités de consolidation de la paix, de prévention des conflits, de médiation et de politique de sécurité, de la présidence de la PSC, des bureaux géographiques et des autres structures thématiques concernées, placé sous l'autorité de la VP/HR et du secrétaire général exécutif et avec la participation des structures d'aide humanitaire, de protection civile et de sécurité intérieure de la Commission en fonction des circonstances; ces réunions seraient coordonnées par le directeur général pour assurer la réponse aux crises; invite la VP/HR et la Commission à doter cette structure d'un système efficace d'alerte et d'urgence et d'une grande salle opérationnelle unifiée, située au siège du SEAE, capable d'assurer une surveillance 24 heures sur 24, sept jours sur sept, évitant ainsi l'existence de chevauchements opérationnels, qui cadrent rarement avec la nécessité de disposer d'un système adapté de surveillance et de réaction rapide aux crises; une coordination et un échange réguliers doivent être assurés entre ce système et le centre européen pour l'intervention d'urgence actuellement mis au point par la Commission afin de garantir des synergies appropriées tout en respectant les compétences spécifiques de chacun;

In accordance with Directive 2006/73/EC, management companies should prevent their employees who are subject to conflicts of interest or in possession of insider information, within the meaning of Directive 2003/6/EC of the European Parliament and of the Council of 28 January 2003 on insider dealing and market manipulation (market abuse) , from entering into personal transactions that are the consequence of a misuse of information they have acquired through their professional activity.

Even though this report may appear to be very much based on consensus, and as has been said in some reports I have read, is of little media interest, involved little internal conflict, little external conflict, and little of anything, it certainly represents a great deal for countries that have young democracies and must hold elections.
− (FR) Monsieur le Président, je voudrais remercier tous mes collègues qui ont pris la parole et dire à quel point les mots chaleureux de Mme Isler Béguin, par exemple, traduisent bien l'enthousiasme de ceux qui ont participé à des missions électorales, même si ce rapport peut apparaître aujourd'hui comme très consensuel et, finalement, comme on l'a dit dans certains rapports que j'ai lus, non médiatique, faible en intérêt médiatique, faible en conflit interne, faible en conflit externe, faible en tout, mais représentant certainement beaucoup de choses pour les pays qui sont de jeunes démocraties qui doivent voter.

At what stage in a conflict we have been unable to prevent are we obliged to deal with it by military means, as opposed to the civil means we had used previously? When, following the end of a conflict, can we again consider going back whence we came without jeopardising people’s safety, and what instruments do we need to that end?
À quel moment, dans un conflit que nous n’avons pas pu empêcher, sommes-nous contraints de recourir à nos capacités militaires, alors que nous avions auparavant utilisé des moyens civils? À quel moment, après la fin d’un conflit, pouvons-nous envisager de revenir à notre situation initiale sans mettre en danger la sécurité des populations et de quels instruments avons-nous besoin à cette fin?

We fully agree with the strategic principle set out by the Commission, and I quote, “the development policy and other cooperation programmes constitute the most powerful instruments the Community has to deal with the causes of conflicts”.
Nous sommes tout à fait d'accord avec le principe stratégique énoncé par la Commission, pour qui la politique de développement et d'autres programmes de coopération constituent les instruments les plus puissants dont la Communauté dispose pour traiter les causes des conflits.
