2. The Commission had asked the Court to annul Council Framework Decision 2003/80/JHA of 27 January 2003 on the protection of the environment through criminal law[1], which required the Member States to provide for criminal sanctions in the case of the offences against environmental law set out in the Framework Decision, on the grounds that the power to impose such an obligation on the Member States is a matter for a Community instrument and the Commission had in fact proposed the adoption of such an instrument[2].

[6] At the same time, the Commission completed the evaluation of the working of the Dublin Convention which the Council had asked it to undertake.

In its Communication on Air Transport and Environment - Towards meeting the challenges of sustainable development ("the Communication") the Commission has stressed the importance of bringing the ongoing work programme on aviation and environmental issues within CAEP to a satisfactory conclusion by decisions of the ICAO Council and the 33rd ICAO Assembly scheduled for September 2001, thus paving the way for avoiding a worsening of the situation in the shorter-term and for improving the environmental situation on the medium- and longer-term in order to remedy development trends which are not sustainable in a business as usual scenario.The Council of Transport Ministers and the European Parliament supported this message of the Commission's Communication on Air Transport and Environment presented in December 1999.
Dans sa communication sur les transports aériens et l'environnement (ci-après «la communication»), la Commission a souligné à quel point il importe de mener à bien le programme de travail actuel du CPEA sur les questions relatives à l'aviation et à l'environnement, dont les conclusions seraient sanctionnées par des décisions du Conseil de l'OACI et de la 33e assemblée de l'OACI, prévue pour septembre 2001. Il s'agit de prévenir une dégradation de la situation à court terme et de redresser la situation à moyen et à long terme pour contrer une évolution qui ne serait pas durable si on laissait les choses suivre leur cours. Le Conseil des ministres des transports et le Parlement européen ont souscrit à ce point de vue exprimé par la Commission dans sa communication sur les transports aériens et l'environnement, présentée en décembre 1999.
