All of the information contained in train driving licences, complementary certificates and registers thereof should be used by the safety authorities to facilitate evaluation of the staff certification process provided for in Articles 10 and 11 of Directive 2004/49/EC of the European Parliament and of the Council of 29 April 2004 on safety on the Community’s railways and amending Council Directive 95/18/EC on the licensing of railway undertakings and Directive 2001/14/EC on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure and safety certification (Railway Safety Directive) (2) and to speed up the issuing of the safety certificates provided for in those Articles.

A mandatory maintenance certification system for all actors in the market, e.g. railway undertakings, infrastructure managers, keepers or any other entity which can be certified as an entity in charge of maintenance according to criteria and requirements set out in this directive, will create a level playing filed in the EU. This will ensure a uniform application of the maintenance and safety management system across Europe without discriminations while at the same time it will enhance safety on the Community’s railways.

Since the objective of this Directive, namely further developing and improving safety on the Community’s railways, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale of the action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

The entry into force of Directives 2001/12/EC of the European Parliament and of the Council of 26 February 2001 amending Council Directive 91/440/EEC on the development of the Community's railways (6), 2001/13/EC of the European Parliament and of the Council of 26 February 2001 amending Council Directive 95/18/EC on the licensing of railway undertakings (7) and 2001/14/EC of the European Parliament and of the Council of 26 February 2001 on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure and safety certification (8) has had an impact on the implementation of interoperability.

National rules are to be notified to the Commission both in accordance with Directive 2008/57/EC of the European Parliament and of the Council of 17 June 2008 on the interoperability of the rail system within the Community (recast) (4), (hereinafter referred to as the ‘Railway Interoperability Directive’), and Directive 2004/49/EC of the European Parliament and of the Council of 29 April 2004 on safety on the Community's railways (Railway Safety Directive) (5).

Currently, the Commission is closely monitoring the financing of railway enterprises not only in France but all over Europe. This is done in order to assure that the financing of railway enterprises is in accordance with European legislation, in particular with Council Directive 91/440, on the development of the Community’s railways, as modified by Council Directive 51/2004 , and the State aid rules as laid down in Article 87 and 88 of the EC Treaty.

The railway package’s four rapporteurs – Mr Jarzembowski, who was responsible for the report on the development of the Community’s railways; Mr Savary, who was rapporteur for the report on a European Railway Agency; Mr Dirk Sterckx, who was responsible for the report on safety on the Community’s railways; and Mrs Ainardi, who was responsible for the report on the interoperability of the trans-European rail system – have all helped inject life into the European railway sector.
