There is no EU legislation on the aquaculture sector at present, and it continues to be covered by a plethora of EU legislation and national rules which can vary significantly between states, creating a legal framework lacking in transparency and discriminatory situations and market distortions that do little to encourage investment in the sector. The Commission adopted an initial communication in 2002, which was the subject of a European Parliament legislative resolution of January 2003, has failed to increase the transparency of the regulatory framework. On the contrary, the Commission and Council have continued to adopt, often via the comitology procedure, detailed rules applicable to aquaculture (organic and otherwise), in respect of which Parliament has had no opportunity whatsoever to voice a direct opinion. The recent Commission communication of April 2009 which forms the subject of this report therefore provides the chance to assess the appropriateness of introducing a specific EU framework for the aquaculture sector, with the ultimate objective remaining the structured development of a sustainable European aquaculture industry which respects environmental balances, increases the economic worth of aquaculture operators and their local communities and offers consumers more guarantees.

With this report Parliament is sending out a strong political plea to the Commission and the Member States to update the conditions for online business and to take steps to enhance consumer confidence as regards the most recent trends in the digital environment. Businesses and consumers are waiting for unequivocal, simple, enforceable rules that will enhance online business culture in the European market.
Par ce rapport, le Parlement européen transmet une requête politique forte à la Commission et aux États membres, pour qu’ils adaptent les conditions du commerce électronique à la situation actuelle et prenne des mesures pour accroître la confiance des consommateurs dans les dernières tendances apparues dans l’environnement numérique. Les entreprises et les consommateurs réclament des règles claires, simples et applicables destinées à promouvoir la culture du commerce électronique sur le marché européen.

The Commission report 'Consumer policy strategy 2002-2006', and indeed the Whitehead report, are both extremely positive steps in this direction.

By 12 June 2011 the Commission shall submit to the European Parliament and the Council a comprehensive report on the application of this Directive, in particular of Articles 3(9) and 4 and Annex I, on the scope for further harmonisation and simplification of Community law relating to consumer protection, and, having regard to Article 3(5), on any measures that need to be taken at Community level to ensure that appropriate levels of consumer protection are maintained.

The ECOFIN meeting on 7 May 2002 invited the Commission "having involved relevant supervisory authorities and Ministries of Finance and taking account of the views of the industry and consumers, to bring forward as soon as possible its report on the appropriate arrangements that are needed to facilitate the consistent implementation and enforcement of regulation including supervisory practices, in line with the recommendations of the Economic and Financial Committee's report on financial integration, to allow its use by the EFC" as a basis for EFC's own report.
