22 (1) Where a seaman is not a resident of Canada and by the law of the place or country in which he resides compensation in respect of accidents is payable and an accident happens in respect of which he is entitled under this Act to receive compensation for permanent total disability or permanent partial disability, then, notwithstanding anything in this Act, the amount of compensation payable under this Act shall not exceed the amount of compensation that would be payable had the accident happened in the place or country in which he resides.

That scheme lays down restrictions in comparison with the assessment criteria applied to damage arising from other types of accidents and limits the court’s discretion to increase the amount of compensation in view of the circumstances of the case, restricting such an increase to one fifth of the amount provided for.

While I support the rapporteur’s original proposals to increase the amount of the minimum sum insured to EUR 10 million per accident for personal injury, and to EUR 5 million per accident for damage to property, I regret the fact that that this position has been replaced by a compromise involving smaller amounts.
