In the light of the Framework Agreement on relations between the European Parliament and the European Commission signed on 20 October 2010 (‘the Framework Agreement’) and the Interinstitutional Agreement between the European Parliament and the Council concerning the forwarding to and handling by the European Parliament of classified information held by the Council on matters other than those in the area of the Common Foreign and Security Policy signed on 12 March 2014 (‘the Interinstitutional Agreement’), it is necessary to lay down specific rules on the treatment of confidential information by the European Parliament.

The act gives the force of law to the tripartite agreement of August 25, 2003 and it accords that agreement paramountcy over the act itself and over any regulations which are passed pursuant to the act (1615) It is noteworthy and worth mentioning that the manner in which the agreement and the act have been placed before this Parliament are in effect by way of a notice of ways and means motion. In November 2009, the Presidency of the Council of the European Union and the United States Government signed an interim agreement concerning the processing and transfer of financial messaging data from the EU to the US for TFTP purposes, which the European Parliament did not endorse.[71] On the basis of a new mandate, the European Commission negotiated a new draft agreement with the US, presenting to the Council on 18 June 2010 a proposal for a Council Decision on the conclusion of the Agreement between the European Union and the United States of America on the processing and transfer of Financial Messaging Data from the European Union to the United States for the purposes of the Terrorist Finance Tracking Program (EU-US TFTP Agreement).[72] The European Parliament gave its consent to the conclusion of this agreement on 8 July 2010.[73] The Council is now expected to adopt a Council Decision concluding this agreement, following which the agreement would enter into force via an exchange of letters between the two parties.

His discretionary powers are such that one must almost be reckless to accept a job with such responsibilities. He makes the decisions about taxes, he announces binding decisions for a specific date, he manages the national debt and the borrowings without any interference on the part of the elected members of Parliament, he deals with international financial institutions such as the International Monetary Fund and the World Bank without members of Parliament having any say in the process, he forgives the debt of poor countries with a stroke of a pen, he signs international agreements that commit our country, he administers pensions without an annual review by the two Houses of Parliament, he pays salary increases resulting from collective agreements in the public service, all without the involvement of parliamentarians, and so on.
