TRADUCTIONS EN CONTEXTE

Alongside and linked to the national trade mark systems, Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark, codified as Regulation (EC) No 207/2009 (hereinafter referred to as ‘the Regulation’), established a stand-alone system for the registration of unitary rights having equal effect throughout the EU.
Parallèlement aux systèmes de marques nationaux, et en liaison avec eux, le règlement (CE) n° 40/94 du Conseil, du 20 décembre 1993, sur la marque communautaire, codifié par le règlement (CE) n° 207/2009 du Conseil (ci-après dénommé, «le règlement»), a créé un système autonome d'enregistrement de droits unitaires qui produit les mêmes effets dans toute l'UE.

The goods and services in respect of which trade mark registration is applied for shall be classified in conformity with the system of classification established by the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks of 15 June 1957 (‘the Nice Classification’).

(35a) In order to contribute to improving the performance of the entire registration system and to ensure that trade marks are not registered where there are absolute grounds for refusal, including, in particular, where the trade mark is descriptive or non-distinctive, or of such a nature as to deceive the public, for instance as to the nature, quality or geographical origin of the goods or service, third parties should be able to submit to the central industrial property offices of the Member States written observations explaining which of the absolute grounds constitute an obstacle to registration.

Council Regulation (EC) No 1992/2003 of 27 October 2003 amending Regulation (EC) No 40/94 on the Community trade mark to give effect to the accession of the European Community to the Protocol relating to the Madrid Agreement concerning the international registration of marks adopted at Madrid on 27 June 1989 [Official Journal L 296 of 14.11.2003]. These two texts are designed to establish a link between the Community trade mark system and the international trade mark registration system of the World Intellectual Property Organisation (WIPO) The aim is to enable enterprises to obtain protection for their trade mark on the basis of the filing of a single application, not only throughout the Community, as a Community trade mark, but also in countries which had signed the Madrid Agreement (such as China).
Ces deux textes visent à établir un lien entre le système de la marque communautaire et le système d'enregistrement international des marques de l'Organisation mondiale de la propriété intellectuelle (OMPI). L'objectif est de permettre aux entreprises d'obtenir, grâce au dépôt d'une demande unique, la protection de leur marque, non seulement dans toute la Communauté en tant que marque communautaire, mais également dans les pays parties au Protocole de Madrid (tels que la Chine).
