30. Expresses its concern regarding the state of conservation, restoration, preservation and promotion policies for cultural heritage, which is of the greatest importance for European identity; stresses that funding for the safeguarding of cultural heritage has been drastically reduced in some Member States as a consequence of the economic and financial crisis; to this end, calls on the Commission and the Member States to ensure that adequate funds and initiatives are directed to the valorisation of Europe’s cultural heritage;

K. whereas Article 167 TFEU states that Union action shall be aimed at improving the knowledge and dissemination of the culture and history of the European peoples, encouraging cooperation between Member States and, if necessary, supporting and supplementing their action in the area of the conservation and safeguarding of cultural heritage of European significance;

The programme objectives have contributed to the aims set out in Article 167, whereby the action of the Union shall support and supplement the action of Member States in improving the knowledge and dissemination of cultural heritage of European significance, conserving and safeguarding cultural heritage of European significance, non–commercial cultural exchanges, and artistic and literary creation.

Article 3. 3 of the Treaty on European Union provides that “The Union shall respect its rich cultural and linguistic diversity, and shall ensure that Europe's cultural heritage is safeguarded and enhanced”.

However, the free movement of goods is not the only issue at stake here - the proposal also concerns the protection of cultural heritage. A reference to Article 167 TFEU on Union action in the cultural sphere, and in particular to paragraph 2 of that article, which deals with the conservation and safeguarding of cultural heritage of European significance, which include national treasures, and cooperation between the Member States would thus have cleared the way for an approach more consistent with the EU's ambitions in the cultural sphere.
Aussi, une référence à l'article 167 du traité FUE relatif à l'action de l'Union dans le domaine culturel, notamment à son paragraphe 2 qui vise la conservation et la sauvegarde du patrimoine culturel d'importance européenne, dont relèvent les trésors nationaux, et la coopération entre États membres, aurait permis une approche plus conforme aux ambitions de l'Union en matière culturelle.

Promoting tangible and intangible cultural heritage, in the light of, inter alia, the 2003 Unesco Convention for the Safeguarding of the Intangible Cultural Heritage and the 1972 Unesco Convention Concerning the Protection of the World Cultural and Natural Heritage, should also contribute to the enhancement of the value of the relevant sites whilst giving to peoples a sense of ownership of the cultural and historical value of such sites.
La promotion du patrimoine culturel matériel et immatériel à la lumière, entre autres, de la convention de l'Unesco de 2003 pour la sauvegarde du patrimoine culturel immatériel et de la convention de l'Unesco de 1972 concernant la protection du patrimoine mondial, culturel et naturel, devrait également contribuer à la valorisation des sites concernés, tout en incitant les populations à s'approprier la valeur culturelle et historique de ces sites.

6. Calls on the governments of Armenia and Azerbaijan to comply with their international commitments, in particular as regards culture and the safeguarding of cultural heritage, entered into within international bodies such as UNESCO and the Council of Europe, and calls on both countries to do their utmost to protect archaeological, historical and cultural heritage on their territories in order to prevent the destruction of other endangered sites;
6. appelle les gouvernements arménien et azéri à respecter les engagements internationaux, en particulier dans le domaine culturel et de la conservation du patrimoine, qu'ils ont pris dans le cadre de leur participation à des instances internationales telles que l'UNESCO et le Conseil de l'Europe, et les exhorte à tout mettre en œuvre pour protéger le patrimoine archéologique, historique et culturel présent sur leur territoire, en vue d'empêcher la destruction d'autres sites menacés;

(ii) to encourage the development of international cooperation between institutions and/or operators, in order to contribute to exchanges of know-how and the development of best practice as regards conservation and safeguarding the cultural heritage.
