Although the ICT proposal and the Blue Card directive both seek to develop instruments in the field of highly qualified legal migration, their scope is very different: the Blue Card directive defines the conditions of entry and residence of third-country nationals for the purposes of highly qualified employment with employers in the EU and without time limits; on the other hand, the ICT proposal requires applicants already to have a work contract with the employer and to be transferred within the same group of undertakings for a period of one to three years, depending on the type of contractual relationship with the individual worker.

It need not be decided whether there is any covert unequal treatment of non-residents compared to residents because it may be that, where its parent undertaking is non-resident, in the vast majority of cases the retail undertaking is integrated in a group company structure. In any case, for the purposes of the assessment of the Hungarian special tax on the basis of turnover, retail undertakings which are part of a franchise structure and those belonging to a company group are not in an objectively comparable situation.

As explained in more detail in the following section, the Commission considers that the measure at issue is selective in that it only favours certain groups of undertakings that carry out certain investments abroad and that this specific character is not justified by the nature of the scheme, regardless of whether the reference system is defined as the rules on the tax treatment of financial goodwill under the Spanish tax system (see recitals 92 to 114) or as the tax treatment of goodwill deriving from an economic interest taken in a company resident in a country other than Spain (see recitals 115 to 119).
