10. No person, unless licensed to do so, shall carry on any business or trade subject to excise or use any utensil, machinery or apparatus suitable for carrying on that business or trade or, not being licensed as a distiller or licensed to carry on the business of rectifying spirits, import, make or begin to make any still, rectifier or other apparatus suitable for the manufacture or rectification of spirits.
10. (3) Nothing in this section applies to anyone duly licensed to carry on the trade or business of a distiller or the trade or business of rectifying spirits.

(a) the person about to import or make any still, worm, rectifying or other apparatus suitable for the manufacture of spirits or for the rectification of spirits, before the importation or making is commenced, reports in writing to the nearest collector his intention in relation thereto, stating the number of stills, worms, rectifying or other apparatus or part thereof, suitable for the manufacture of spirits or for the rectification of spirits, to be imported or about to be manufactured, showing, with reference to each

(2) Any use made of any still, worm, mash-tub or fermenting-tun, rectifying or other apparatus suitable for the manufacture of wash, beer or spirits, for the distillation or rectification of any spirits or for fermenting any beer or wash, or the making or commencing to make, or the importation of, any such still, worm, mash-tub, fermenting-tun, rectifying or other apparatus, shall be deemed to be a working of a distillery and acting as a distiller within the meaning of this Act.
(2) L’utilisation d’un alambic, d’un serpentin, d’une cuve-matière ou d’un tonneau à fermentation, d’un appareil de rectification ou autre, propre à la fabrication du moût fermenté, de la bière ou de l’eau-de-vie, à la distillation ou à la rectification de l’eau-de-vie, ou à la fermentation de la bière ou du moût fermenté, ou la fabrication ou le commencement de fabrication, ou l’importation de tout semblable alambic, serpentin, cuve-matière, tonneau à fermentation, appareil de rectification ou autre, est considéré comme l’exploitation d’une distillerie et un acte de distillateur pour l’application de la présente loi.
